Why do people inflict such pain and damage on nice giving people. My friend, a Green Party member and local musician had an injustice played upon him.

Tuesday morning, January 13 sometime between 2AM and 9AM after playing the open mic at the Boiler room, some body smashed out the back car door window on Frank Mancinelli's hatchback in front of his home on Harris Street in Eureka, CA. Obviously the perpetrator was on foot because they made off with two guitars, a a brown sunburst Silvertone with vinyl siding, the other a Fender silver metal flaked Squire Jazzmaster with a red devil girl decal and left his amplifiers.

Paul Pitino, Experience Counts!

In response to my reader writer, I recently viewed Paul Pitino http://www.paulpitino.com/ debating on League of Women Voters-sponsored televised debates on KEET, with 3rd District candidates Mark Lovelace and Bryan Plumley. Paul Pitino, a current member of the Arcata City Council and self-employed landscaper, called for building up existing small businesses.

Lovelace made vague "pie in the sky" wishes for breeding money grubbers who would sell out to a corporation to ensure revenue from outside sources. For Mark Lovelace, a manufacturing consultant, the key is assisting and attracting and assisting small businesses that produce products sold around the country and the world. ( In other words, sweat factories!)

Plumley is out to save the Planet and not his community. He wants to shut down local "Ma and Pa" Grow houses thus ensuring that dispensaries do not become a dominant part of the local economy. ”There's a huge opportunity to brand Humboldt County with environmental values,” he said. The resulting reputation could demand premium returns in out-of-the-area sales." That is great, but when do we start dealing with real issues like Police Watch Groups, Homeless Dwellings, and Transportation Related Issues?

The city of Arcata's recently completed land use guide, Pitino said, addresses many of the challenges posed with the presence of medical marijuana dispensaries within the municipality. He called for the clinics to be secure and confined. So, regardless of what you think about the Arcata City Council, Pitino recognizes the importance of legitimacy with such things as Medical Marijuana.

Pitino also encouraged expanding public bus service to seven days a week and evenings.

”Having a bus system that works is a real shot in the arm for economic development,” he said.

Candidate Walters no stranger to controversy

She's been compared to Chicken Little and Ma Kettle and criticized literally head to toe - from her red hair to her naked toenails.

But in the past eight years on the Mesa City Council, Claudia Walters also has earned a reputation for her intimate knowledge of city issues, her snappy wit, her face-to-face approach to community problems and her passionate dedication to public service.

Many see her years of experience as a plus, but Walters has more history and hurdles to overcome in the March 11 mayor's election than her opponents - businessman Scott Smith and former Councilman Rex Griswold, whose city tenure lasted five years.

Some of Walters' most public decisions have been the Bailey's Brake Service eminent domain controversy, the overwhelming defeat of a property tax and the closing of the city-owned Escobedo Apartments that displaced many low-income residents.

And in a year when female politicians are shattering glass ceilings on a national level, Walters, 54, is in line to be just Mesa's second woman mayor - a concept that scares some people enough to say it to her face.

But in a three-person race so close that some are endorsing all candidates, Walters stands out as having the most lucid and specific plan, laid out for her first 100 days in office, which includes improving blight, connecting police with communities and emphasizing education opportunities in the city.

Walters said she got her first taste of community service over family dinner.

Her father, William Reeder, was a professor of rural sociology at Cornell University in Ithaca, New York, and worked to get regular people more involved in their communities.

"People ask me how I got interested in community things, neighborhoods and all those kinds of things," she said. "Well, I grew up with that at my dinner table."

After Walters' sophomore year in high school, her father was scheduled to teach for one year at Brigham Young University in Utah on sabbatical from Cornell and planned to move the family.

Rather than lose her place in line as editor of the yearbook, Walters figured out she could graduate early from high school and enter BYU as a freshman at 16. By 19, Walters was a college graduate and went on to earn her teaching certificate.

She married Steve Walters in 1975. Two years later, with their first child in tow, the Walterses moved to California, where Stevewas to start with a fledgling technology company: Intel.

In 1984, Intel began transferring families out of Silicon Valley, and the Walterses chose to come to Mesa, impressed with its schools and music programs.

Walters lived in Mesa for about a year before she was asked to serve as president of a parent-teacher organization. There, she saw problems that went beyond a single school and decided to run for the Mesa Public Schools Governing Board. She won one of the three open seats.

During her time on the school board, Walters was instrumental in creating alternative programs for students, like the arts emphasis at Highland High School.

"I'm very proud of that," Walters said. "In a way, we led the charter school movement."

School board member Mike Hughes served with Walters and said she was respectful and courteous of dissenting opinions, but also very strong.

"She was able to take her position but make you feel that you were heard and respected," he said. "And that's a nice quality to have."

Walters served on the school board from 1993 to 1996, when she ran for re-election but lost in a race she said came down to money, and she wasn't willing to dip into her retirement fund.

"Was it difficult? Maybe for a couple minutes," Walters said of losing her first race. "But I had a really great clarifying moment in the midst of that. I realized somebody else can do this job. It's really all right."

The next year, Walters was tapped by then-Mayor Wayne Brown to fill a vacant seat on the City Council for seven months. She served out the term, then was elected in 2000.

Walters was on the council for a year when the Bailey's Brake Service battle erupted.

The city had tried to use eminent domain to shut down the auto shop in downtown Mesa but was struck down in court and nationally flogged for abuse of government power.

Walters said that the city had been following the traditional path of redevelopment but thinks it was not handled well.

"There are times in your life you'd like do-overs," she said. "Knowing what I know now, I would do everything different."

The conflict brought national attention and a handful of candidates to oust Walters and others from office. Those efforts, however, were unsuccessful, and Walters was re-elected in 2004.

Two years later, Walters found herself in the middle of another heated public debate - this time about the proposal to levy Mesa's first property tax since 1947.

Walters said she supported the primary property tax because a proposal to increase sales tax went along with it. She said she knew the property tax was not going to pass.

The campaign before the May 2006 vote brought talk of severe budget cuts.

The public revolted, saying that city officials were acting like Chicken Little in predicting Armageddon if the tax didn't pass.

The Arizona Federation of Taxpayers wrote, "Pro-tax Councilwoman Claudia Walters is already playing the 'starving children card,' warning the city would have to shut down libraries, parks and recreation programs, pools or the arts."

The property tax was defeated with 60 percent of the vote, while the sales tax increase was approved.

One year after the property tax defeat, Mesa was considering a move to help the financial situation: sell the city-owned Escobedo Apartments but displace dozens of residents.

Although most agreed that the city should not be in the housing business, former Escobedo resident Pam Wilson said she felt the council was treating the residents "like idiots."

"She showed us a lot of disrespect," Wilson said of Walters. "She was laughing at us. We felt very belittled. And I called her office and told them so."

Wilson has since moved and the property is nearly empty. But she never wants to go through another move like that.

"I am going to dance at the new mayor's celebration party, and it will not be Claudia or Rex (Griswold) if I have anything to say about it," she said.

Throughout her campaign, Walters has said there is too much negative talk about living in Mesa. One of her main slogans is to "change the conversation," and tout the city's benefits, like schools and family communities.

One of her first moves as mayor would be to capitalize on that conversation and encourage residents to invest in their homes and businesses. She's calling it "Mesa Clean and Green."

Walters plans to ask people to step outside and put a fresh coat of paint on their homes or clean up their parking lots, because "people equate clean with safe."

Residents would be encouraged to send in "before and after" pictures and be publicly lauded for their efforts.

Along those same lines, Walters said she would invite residents to give back to the city in some way - sort of a John F. Kennedy plea to ask what you can do for your city.

"We're not talking about money. Even if it's just to go to your kid's parent-teacher conference. Or organize a food drive," she said. "Do something to give your heart to Mesa."

That program would be linked to privately funded community scholarships - maybe only a couple hundred dollars - but again publicly recognizing residents who participate to build the buzz.

"Mesa Clean and Green" also would include talks with grocers to find an outlet for used plastic grocery bags, creating nonfinancial incentives for developers to build "green" and a citizen committee to support environmental programs.

To bolster public safety, Walters plans to tap her many neighborhood contacts to identify areas needing the most attention. She would then invite neighbors and police officers to meet in the mayor's office and talk about common solutions.

Walters said she is dedicated to reducing nonemergency medical calls, an effort that would further a current program using small fire trucks for lesser calls.

She plans to tap her experience on the school board to promote education in the city with a program called "Mesa LEARNS: Leading in Education, Advancement, Reading and New Skills." The program would tout the city's connections with Maricopa Community Colleges, Arizona State University and the public library system.

As Mesa faces a multimillion-dollar budget crunch, the next mayor will be charged with fixing the finances. Walters supports levying a secondary property tax to fund bond projects. Past bond projects have been funded with sales tax revenue, a model she said no longer works.

Walters plans to hold training sessions for the new City Council, which will have five new members, to more fully understand the city budget.

Although it has been suggested before, Walters said she would bring back the idea of providing unpaid internships to students to help with city office work and earn college credit.

Mayor Keno Hawker has officially endorsed Walters, citing her knowledge of city finances and big-ticket issues like transportation and water.

That history and background alone would probably be enough, he said, but he also likes her positive message.

"I think I've been pretty good at identifying what's wrong, and I get blamed for identifying it," he said. "I like her message about what's right for Mesa."

Hawker eschewed critics' notions that Walters drowns in the details and lacks vision for the big picture.

"I think just the opposite," he said. "I think she has the big picture but can go down to the neighborhood level. She has the ability to do both."

Another common complaint about Walters' campaign is that she has had eight years to achieve her goals and "couldn't get the votes."

It is probable that no one has voted against Walters more than Councilman Tom Rawles, whom she described as diametrically opposed to her views.

Rawles said that Walters sees the role of government as taking an active role in people's lives and cited her plan to regulate the location of payday loan stores.

"Fortunately, I was able to deflect her on that," Rawles said. "I don't think the government should dictate. She was trying to do it from a perception standpoint, but there's no reasons for these restrictions."

But even Rawles described Walters as fair, thoughtful and bright and as playing a large role in things the city is doing right.

"The city is on the right track now," he said. "She needs to make people aware of these. She needs to make people understand that things are better."

If American democracy were to submit to a checkup - blood pressure, cholesterol, weight - some troubling symptoms would be recorded on its chart. Topping the list is low voter participation. Barely 50 percent vote in national elections, and even fewer in local and off year elections. That's like someone who brushes his teeth every other day - not good for his health, and not good for those around him.

There are other alarming symptoms: Millions of Americans are not members of a political party (one-third here in Maine), yet federal and state governments are dominated by Republicans and Democrats. And even though the concept of political parties is not addressed in the U.S. Constitution, candidates who are neither Ds nor Rs must jump over some pretty high hurdles to get on the ballot (in Maine, those hurdles are lower).

Also worrisome: 21st century Americans may be the most poorly informed in the country's history about decisions affecting their tax dollars, military, privacy and other Constitutionally guaranteed rights, in part because many get their news through the colored lenses of talk radio, the bickering partisan feuds of pundit TV, or "fake news" shows like Comedy Central's The Daily Show.

Jesse Johnson, a stage, TV and film actor and director, is a candidate for the Green Party's presidential nomination, vying with three other candidates for the party's nod. He's visited Maine in recent weeks, courting the state's 44 delegates to the Green's national convention (the second largest number in the U.S.). While Mr. Johnson is no doctor - though he may have played one on TV - he is able to accurately diagnose what's ailing America.

A registered Republican for 26 years, Mr. Johnson, 49, returned to his native West Virginia a few years ago to care for his grandmother and was horrified to see the devastation that mountaintop removal coal mining had wrought on Appalachia. He helped move the state's Mountain Party under the Green Party umbrella, ran for governor in 2004 garnering 3 percent of the vote, and ran for U.S. Senate in 2006, winning 2 percent of the vote.

Greens are not the only ones on the outside looking in. Whether Libertarian, Constitution, Taxpayers, or other, lesser known parties, their concerns were remarkably consistent, Mr. Johnson said, wanting transparency, access, responsiveness, accountability to individuals over corporations and Constitutional purity returned to government.

The often-heard refrain from voters justifying their choice of a candidate as "the lesser of two evils" may be the most life-threatening symptom of all, Mr. Johnson says. America deserves a more healthy democracy.

How About a 4 way Race in November?

We know John McCain will be on the presidential ballot in November. It’s also safe to assume he’ll be up against Barack Obama or Hillary Clinton. In most states, Ralph Nader will probably be there, too, though his influence is likely to be limited.

The next question, though, is who else might appear on the ballot.

One need not look too hard to find Democrats unhappy about the prospect of Nader splitting the left and helping McCain, but it’s worth keeping in mind that Republicans may have a couple of challenges of their own.

For example, Alan Keyes — who, rumor has it, kinda sorta sought the Republican nomination this year — is moving closer to another campaign outside the confines of the GOP.

Former Republican presidential candidate Alan Keyes announced Tuesday night that he has left the GOP and is considering joining the Constitution Party…. “They’re considering me, I’m considering them,” Keyes said in a conference call late Tuesday night. “We have so much in common that I find it hard to believe we won’t be able to work out a common basis for working together.”

For that matter, if Nader makes it a three-way race, and Keyes makes it a four-way race, there’s also the prospect of Bob Barr making it a five-way race, running as the Libertarian Party’s candidate.

Third parties rarely matter at the presidential level, and I suspect the McCain campaign isn’t especially worried about Keyes or Barr. It’s not even clear if either would be able to qualify for the ballot in every state.

But in a close contest, a percentage point here or there might matter. At a minimum, it’s something to keep an eye on.

The history of the United States is littered with third parties that
for a few years attain great publicity and attention, then disappear
from sight. Mostly they are populated by people espousing fringe
philosophies, though occasionally some of these ideas are adopted
years later by the two mainstream parties.

Until recently we had a vibrant Green Party in Humboldt County. They
were everywhere and were a force to be reckoned with in some local
elections.

But the most recent figures from the office of the California
secretary of state show a dramatic decline in registered Green Party
membership. While the total number of registered voters has remained
fairly constant, as of Dec. 7 there were 3,660 registered Greens or
4.94 percent in Humboldt County versus 5,396 or 7.05 percent just five

years ago.

Many of the Green Party members I knew were committed, sincere and
dedicated individuals who strove to not only live the ?10 Key Values,?

but wanted to offer a viable alternative to voting Democrat or
Republican. And while I have been a lifelong Democrat, I admired their

fighting spirit and resolve.

Yes folks, you'll be either glad or sad to learn that we officially no longer exist after David Cobb and his ever-shrinking crew of sychophants voted to "dissolve" each and every local organization in Humboldt County, declaring them lacking in public interest. Funny, doesn't seem to be too much interest in the "offical" county party Cobb controls, with all of three people at their last meeting! Didn't this same bunch attack Greg Allen for letting the Arcata Greens take action with three people at their meetings?

Whereas, Local art gallery Empire Squared has been joined in its Third Street building in recent months by Synapsis Gallery, a space for free expression by local artists, and by The Placebo, an all-ages music and performance venue, and,

Whereas, These programs provide a crucially needed space for young people to celebrate life and engage in creative endeavors free of undue commercial influences, drugs and alcohol, and,

Whereas, The Placebo has already had to move twice in recent years, first from Arcata and then from Manila, which deprived young people in those communities of this important resource and creative outlet, and

Whereas, None of these organizations have been involved in any criminal activities or any significant disturbance to their neighbors, especially when compared to the drug houses and other nuisances plaguing many residential neighborhoods in the Waterfront area of Eureka, and,

Whereas, The Eureka Fire Marshall recently ordered public performances at the Synapsis Gallery shut down until several fire code issues relating to disabled access and exit door designations were corrected, wit others suggesting that The Placebo and Empire Squared may soon suffer a similar fate, and,

Whereas, The Limited Industrial Zoning for the property allows activities substantially similar to that which are necessary for the creation of many forms of art, and,

Whereas, The Eureka Planning Commission is empowered under Sections 155-265 through 155-270 of the Zoning Ordinance to consider other uses that may be similar to those listed as permitted and to make a determination that these uses are similar and to authorize Synapsis Gallery, Empire Squared and The Placebo to locate in this district, without going through the rigors of a Zoning Ordinance amendment, and,

Whereas, The generally run-down condition of this area and its dark, deserted nighttime streets can only be improved by these vital and needed programs locating in this area. Therefore be it

Resolution to Establish Grassroots Democratic Control Over Public Access Media

Whereas, The platform for the Green Party of California "demands that everyone has a right to access of the various media for the free expression of their viewpoints," due to the fact that "access to information has profound consequences to our democracy," and,

Whereas, Public access channels for use by local governmental and educational institutions as well as directly by independent producers are mandated by law since the overwhelming passage of the federal Communications Act of 1984 by the U.S. Congress, and,

Whereas, Communities including Eureka have hosted public access stations supposedly available to all Humboldt County residents for over 15 years, the most prominent of which having been Arcataâ€™s Channel 12, which until 1999 was under the auspices of a contract with the independent Arcata Community Access Television (ACAT) and featured a wide variety of local news, commentary and entertainment programs from over 50 independent local producers without fear, favor or censorship, and,

Whereas, Until 1999, the Board of Directors of ACAT was in compliance with state law and its own bylaws in ensuring the regular rotation of the membership of its Board of Directors through periodic elections, and

Whereas, In 1999 and 2000, a small group led by then-ACAT President Roland Yartzoff and closely aligned with City officials, local politicians and The Arcata Eye got rid of most local, independent producers and programming and destroyed the ability of ACAT to function, leading to the termination of its Channel 12 management contract with the City of Arcata, and,

Whereas, During his tenure as ACAT Station Manager, Rob Amerman, who was subsequently the HCTV Station Manager, admitted to illegally confiscating a broadcast tape from an independent producer instead of fulfilling the stationâ€™s contractual obligations to air a public access program, and committed numerous other violations of station rules in clipping shows, including their credits, moving shows unilaterally to different times, damaging broadcast tapes and censoring programming, and,

Whereas, The website of HCTV blatantly admitted that the station is not free of censorship following the hiring of the HCTV Station Manager, with the Channel 12 schedule dominated by satellite programing copied form other stations such as Free Speech Television and the Classic Arts Network, along with out-of-count religious programming as well as bulletin boards exclusionary of Green Party announcements, and,

Whereas, Despite promises of re-introducing democratic oversight and control of Channel 12, the HCTV Board of Convenors, organized under the auspices of the Humboldt Area Foundation, never held a membership meeting or called a fair and free election for a new Board of Directors that they always intended to appoint directly, nor did they address the governance of Eurekaâ€™s Channel 10 or the College of the Redwoods-administered Channel 8, and,

Whereas, Cox Communications, Inc., the former cable provider which hosted Channel 12 and administered Channel 10, concluded franchise renewal negotiations with Humboldt County and the cities of Arcata, Blue Lake, Eureka, Ferndale, Fortuna and Rio Dell, which included both franchise fees to local governments and direct assistance to public, education and government access to the cable system (including financial support and the construction of a permanent facility for public access channels at the companyâ€™s expense), and,

Whereas, With the purchase of the cable franchise from Cox Communications, Inc. by Sudden Link Communications, Inc. and the transfer of public access channels from HCTV to Access Humboldt, Greens and other concerned citizens have the opportunity to ensure true free speech and democracy on local cable access television. Therefore be it

Resolved, The Waterfront Greens applaud the steps taken towards the creation of a somewhat independent Board of Directors of Access Humboldt and encourage an increase in the number of elected seats to form a Board majority in order to ensure true membership empowerment and grassroots democratic control. Be it further

Resolved, The Waterfront Greens demand a fair, free and open election of the Board of Directors by any resident who wishes to join Access Humboldt, regardless of economic or other privilege. Be it further

Resolved, The Waterfront Greens call for the immediate implementation of policies to guarantee the complete political and journalistic freedom from censorship for public access programming that is essential to precluding prior restraint of free expression and ensuring that the diversity of viewpoints reflected includes Greens of every shade. Resolved, The Waterfront Greens ask Sudden Link Communications, Inc. to establish separate stations for Free Speech Television and the Classic Arts Network on the basic tier of service, and not to allow these stations to use Channel 12 cablecast time meant for local programming. Be it further

Resolved, The Waterfront Greens ask the new Board of Directors of Access Humboldt, once the majority of Directors are subject to membership election, to amend their Bylaws (with the ratification of Access Humboldt members) to ensure elections that are open to free competition, meetings that are public, well-noticed and televised as well as station rules which do not overly restrict access to cablecast time, especially in regular time slots, for independent producers. Resolution Calling for a Boycott of All Coca-Cola Corporation Products

Whereas, Coca-Cola Corporation has bottling plants world-wide in many underdeveloped countries; and,

Whereas, Many of these plants are in countries ruled by autocratic regimes or governments that owe their existence to U.S. governmental support; and

Whereas, In Colombia, where Coke has a bottling plant, the U.S. government provides millions of dollars annually as well as military assistance to defeat insurgent forces, despite Columbia’s record as the most dangerous country in the world for trade unionists according to the U.S. State Department; and

Whereas, Union activists at the Coca-Cola plant have been assassinated by right-wing paramilitary groups, including the use of death squads to murder nine members of a national food and beverage workers union in Columbia; and

Whereas, Union activists in Colombia and throughout the world have called upon the international community to boycott Coca-Cola due to these grave violations of human rights; and

Whereas, The platform and values of the Green Party of California urge the careful use of each individual’s economic choices in order to support community and oppose injustice. Therefore be it

Of the Waterfront Greens

Resolution Regarding Sidewalk and Storm Drain Repair

Whereas, The City of Eureka has scheduled a period of discussion regarding sidewalk repair needs; and,
Whereas, City officials have, in violation of the City Council’s own policy that Eureka shall be a "street-tree-lined city," perpetrated a policy of ripping out street trees, some of which have grown in place for over twenty years, the reason given that the sidewalks are being damaged by tree roots; and,
Whereas, City officials have thus far refused to consider the alternative of rebuilding sidewalks to incorporate additional space for tree growth, as well as for planter strips to increase the green space present in the city; and,
Whereas, Water runoff from local rainfall has been found to inundate neighborhoods in Eureka, causing sidewalk, street and property damage to local residences and businesses, and also presenting a public safety hazard to navigation by pedestrians, bicyclists and vehicles, including the egress of schoolchildren to safely get to and from their homes; and,
Whereas, One of the primary causes of this inundation is the City of Eureka’s antiquated storm drain system, which fails to deliver adequate capacity for the amount of rainfall and runoff generated, especially in winter months and especially during periods of unusually high rainfall; and,
Whereas, Climate change affecting local weather patterns may further increase the environmental impact on the storm drain system, increasing the danger of flooding of local residences and businesses; and,
Whereas, Due to the backlog of storm water in insufficient storm drains which spill out onto streets, sidewalks and property parcels, contaminants from vehicles and other point-source pollution are built up in storm surge waters which eventually reach Humboldt Bay, exacerbating bay clean-up issues; and,
Whereas, Of particular concern is the storm drain system in the I Street and J Street neighborhood near the Eureka Women’s Club, Eureka High School and Cooper Gulch, where vast pools of water collect on J Street from Tenth Street to Sixteen Street, with repeated complaints to City officials by residential property owners having generated only inaction from Public Works; and,
Whereas, According to Public Works director such and such, there are over 9,000 water meters in the city which are potentially faulty, which may lead to the chronic overbilling of residents and businesses in the city for water and sewer services they have not used; and,
Whereas, The recent proposal to automate the water meter system may cover up the potential fraud which has taken place due to faulty billing and the negligence therein, despite repeated complaints regarding this system and regarding the attitude of public works officials towards these complaints; and,
Whereas, City officials have also perpetrated a policy of removing benches and bus shelters from local sidewalks, the reason given is that they are being used by homeless people to rest upon; and,
Whereas, These conditions undermine the City Council proclamation of Eureka as a "street-tree lined city," jeopardize the environment, impose an undue burden on local residents and businesses, violate social justice and undermine the confidence of residents in their public works department. Therefore be it
Resolved, The Waterfront Greens demand the alteration of the City of Eureka’s policy regarding the removal of street trees, and instead offering the alternative of reconstructing sidewalks to fit around street trees. Be it further
Resolved, The construction of all new sidewalks and rebuilding of damaged sidewalks shall incorporate tree wells and planter strips so that street trees can be planted and landscaping can be installed. Be it further
Resolved, The Waterfront Greens urge analysis of Humboldt Bay environmental conditions to take into account storm water runoff conditions and to offer recommendations on habitat remediation. Be it further
Resolved, The Waterfront Greens insist upon the restoration of all benches and bus shelters which have been removed in Eureka, as well as consideration of additional bench space throughout the city. Be it further
Resolved, The Waterfront Greens call upon the City of Eureka’s public works department and public safety officials to immediately remediate the buildup of stormwater in the I Street and J Street area. Be it further
Resolved, The Waterfront Greens also urge city officials to conduct an overall study of the storm drain system to increase its capacity and remove threats to public health and safety. Be it further
Resolved, The Waterfront Greens suggest the pruning and clean-up of the upper gully near the I Street and J Street neighborhood to improve its water retention capacity, remove non-native species and improve access to public property by Eureka residents. Be it further
Resolved, The Waterfront Greens insist upon an independent audit of every water meter in the city to ensure precise measurement of water use to increase public confidence in the city’s system. Be it further
Resolved, The Waterfront Greens also insist that any findings of overbilling in such a study shall immediately lead to refunds by the city of Eureka to the affected residents and businesses. Be it further

1. Announcements
• Ed brought a DVD on jet chem. trails to share with anyone who is interested. Anthony took it and will bring it back to pass on to others.
• Heidi asked Kaitlin to mention that we need a new Vice Chair. This will be on the January meeting agenda.

4. County Council Report
• Next meeting is this Tuesday (no County meeting since our last meeting). Jared will be bring our proposal/offer to help pay for the costs of sending a mailer to the Eureka Greens.
• County Greens are co-sponsoring Antonia Juhass with WILPF and Democracy Unlimited in January. Antonia is author of the Bush Agenda. January 7th & 8th. Sunday night at the Labor Temple, Monday night at the Westhaven Center for the Arts. David will call Anthony to remind him, everyone else will get on the email list by contacting Hannah to get the event announcement. Jared asked for help flyering, Aaron & David offered to help, Jared will contact them.

5. Old Business
• Update from Jared on David Giarrizzo’s blog: Jared called him to ask him to change the name of his blog, to avoid confusion of new Greens trying to get involved.
• Update from Kaitlin on EurekaGreens.org: Kaitlin called Xandra who is the owner of this site. Xandra said she needed to get the password from Charles Douglas and would email that to Kaitlin. She has not done that yet.
• Kaitlin created a new website for us at EurekaGreens.com. It is live! Feedback is welcome. Kaitlin will set up the officers with email addresses and check to see if we have enough email addresses allowed in our package to let other Eureka greens have theirname@EurekaGreens.org emails.
• Valentine’s Day Posters: Yvonne & Hannah are interested in working on a poster for Valentine’s Day – publicity for the Green Party. Kaitlin offered to help. They will bring some prototypes to January meeting. We will offer to Greens in other parts of the County to put them up too. David offered to coordinate putting the flyers up.
• St Patrick’s Day event: We discussed whether it would be better to do it as a houseparty or a more public event. General consensus was excitement about an intimate mixer but in a public place, with a band. Most Greens are in Arcata, but we want to build visibility in Eureka, so either location would be OK. We’d like the focus to be a celebration for Greens who are already registered and those who aren’t yet, but who want to be. Jared will bring our ideas and proposal to the Humboldt Greens on Tuesday. Eureka Greens who want to work one this: Anthony, Jared, Aaron, David, Hannah, Kaitlin.

6. New Business – Outreach
• We will table at Eureka events when they come up (Shaye & Jared on the county committee that will do this)
• Phonecalls: Ideas is to make calls from home 2-3 evenings a week, calling a few Greens and talking to them to see what they would like to see the party do, what they are working on already, invite them to our meetings, general assembly and events. Idea to start on this in the new year and invite folks to the St. Paddy’s event. Other ideas – start with the Greens who worked on T & Gallegos campaigns, want to have a script & format in place before the calls start. Yvonne, Jared, Anthony, Aaron, Hannah have energy to help make these phone calls.
• Email Listserve: Hannah set up a topica listserve for the county. She will begin to send announcements about Eureka Greens meetings and direct folks to our website for agendas & minutes. We will look into whether our web package offers listserves. Ed offered to help with dataentry.

7. Ending the War Discussion
We also talked about actions being taken to end the war. We are excited about Dave Meserve’s idea for a ballot initiative in Arcata against military recruitment. We would like to see the Eureka Greens take some action on this in the future. (Noted that anniversary of the war is in March.)

1. Announcements
• Humboldt Exchange Pancake Breakfast, Sunday 19th (10-noon), 1402 M Street (corner of 14th & M). Cost is $5 Community Currency.
• Heidi still has the items from the yard sale and would like help contacting and dropping off the items to a charity – David & Jared offered to help, Heidi will contact them.

2. Adoption of October Meeting Minutes
Minutes approved by unanimous consensus.
Hannah will show Kaitlin how to post the minutes to the county website.

3. Treasurer’s Report
• Kaitlin nominated Hannah to be the new Treasurer. Hannah was elected by unanimous consensus. Heidi will contact Xandra and work with Hannah to put her name on the bank account and take Xandra off as a signer.
• This month Heidi purchased a web domain $95.40.
• Total in the bank is $673.65 ($50 belongs to the County Greens, Heidi needs to make that change.)
• Jared suggested that we give some money to the county greens to help them do some mailings to get people involved, pay for copies etc.
• Heidi suggested we donate a percentage of our monthly balance to the county.
• Hannah pointed out that might take a lot of administrative work to do it every month, and we might not want to always give the county money.
• Kaitlin suggested that we pay for the Eureka portion of the county mailing, so long as they amount does not exceed $300. (If it is a lot less than $300 then we are willing to pay for up to $250 to cover the costs for other localities.) In order to do this we need the mailing to mention the dates, times, location of our meetings and give our website. Jared will report this to the county at their next meeting.
• Proposal approved by unanimous consensus.
• Heidi asked that we ask the people organizing the mailing how many people are in the Eureka Greens jurisdiction.

4. Old Business
A. Eureka Greens Website & Web Administrator:
• Last month we asked Heidi to contact David Giarrizzo and ask him to change the address of his blog so that it does not look like a Eureka Greens site. She was also going to ask him to give us the passwords and access to www.EurekaGreens.org.
• Heidi purchased www.EurekaGreens.com last month.
• Jared will contact David Giarrizzo to tell him the above information and ask him to change the address of his blog.
• Kaitlin will contact James Stratton and Charles Douglas and get the password and web hosting information for www.EurekaGreens.org.
• We will make any posting part of the website open only to registered users, and it will be moderated.
• David nominated Kaitlin to administer and create a new website for us. Kaitlin was elected by unanimous consensus. Ed and Heidi are interested in helping.
• Things we’d like to have: register online, 10 key values, statement of intent, links from Heidi (why I switched), county, other locals, ca greens, national greens.

5. New Business
A. Future Fundraising & Outreach Ideas
• Kaitlin offered to make a poster with our 10-Key values and our meeting times to let people know when we’re meeting, include a voter registration appeal, contact information, she will make these for our meetings in 2007.
• We want to have another yard sale in the spring when the rain stops.
• We’d like to do something for St. Patrick’s Day, and we want to have the County greens take the lead on it and we can help, and encourage the Arcata Local to get involved too.
• What kind of event could we do for Valentine’s Day – Show Your Love for Democracy (Register Green), Show Your Love for the Earth (Register Green), Show Your Love for Peace (Register Green), etc.
• Heidi will invite Fhyre to join the County Greens fundraising event.

The County greens are looking into this and Jared is working with Shaye to do it, he will pass on the information to us about the events in Eureka.

David made the proposal that we endorse Peter LaVallee, Larry Glass, Ron Kuhnel, Nancy Abrams (unanimous consensus). Hannah will also email Nan Abrams to ask her the same questions that we asked the other candidates, just for our information.

All have commitment to the lower income neighborhoods and citizens who live there.

Support LaVallee in part because of his willingness to nominate Xandra to Planning Commission, openness to IRV, support of Police Review, and support for the environment.

Support for Ron Kuhnel in part because of his commitment to the environment, support for Council openness and accountability, commitment to address the pulp mill concerns, his dedication to this community and his leadership experience with the Planning Commission.

Support for Larry Glass in part because of his commitment to local businesses, support and leadership in support for the environment, neighborhood advocacy, commitment to address the pulp mill concerns, and his willingness to speak up for the public process and open government.

Big thanks to Xandra for inviting and recruiting all the candidates who came.

3. NOMINATIONS AND ELECTION OF EUREKA DELEGATE TO HUMBOLDT COUNTY GREENS STEERING COMMITTEE

David Giarrizzo nominated James Nolan, he declined the nomination. James Nolan nominated Monty Caid, he declined the nomination because he hasn’t been very involved yet and wants to learn more first. Kaitlin Sopoci-Belknap nominated Jared Wilken. (with unanimous consensus he was appointed)

4. UPCOMING FUNDRAISER: Yard Sale, October 7th (7am-sundown)
Kaitlin & David will be out of town but they offered their house for storage and have tables they can make available, Hannah will be able to help collect items (442-5109). Xandra can volunteer on Saturday. Jared can help, but he has a workshop that day and doesn’t know the time yet, he will let Heidi know. Heidi will call KMUD for an announcement. Heidi will send an announcement to the Eureka Reporter & the Tri-City Weekly. Xandra and Heidi opened a bank account for the Eureka Greens at Umpqua Bank.

OTHER IDEA:
Evan Utter (of the bank Lovely Silly Delusions) would be willing to play a benefit at the Red Fox Tavern. Xandra and Monty know Evan and can work on this, Evan has most of it already figured out so he’s just going to run with it. They will let us know the date, sometime mid-October.

Former Secretary amused while Eureka Green Party Burns

Hi Folks! I am happy to say that I am still living in Eureka, I am still registered Green, and I share this blog with other Green members not content with the direction the Eureka Greens have gone. (No fault by the current Chairperson, but largely due to David Cobb and his devotees.) The day that Cobb and his druigies take off the makeup, cast away their smarmy semi-professional facade and are exposed for the charlatans they are, that will be the day this Roman enters the forum of meetings with the Eureka Greens. It really irritates David that he can't control everyone he meets. He once made a declaration of a peace treaty immediately followed by a barrage of questions concerning items up for discussion that were posted anonymously on this blog. Cobb wanted to ban any question or item remotely connected with Charles Douglas, and extended that to any person with an IQ larger than David Cobb. I felt that, no matter who it is, registered Green or not, their thoughts and point are valid enough to bring up. So, in response to you Eureka Greens that think I should comply with your demands on changing my blog name, I simply say, "burn, baby, burn!"

*2nd Annual Organic Planet Festival Participant Party Oct 16th at 315 P St, 4:30pm - Heidi got a card addressed to the County Greens, anyone who participated with the Green Party table is welcome to attend (Heidi)
*Hunger Strike in protest of the war, now until the election, at the Courthouse steps every day at noon (Heidi) *Hannah's mom is running as a write in candidate CarolWolmanforCongress.org against Mike Thompson. She's not a Green but she's running largely on a Green platform. Hannah will send an email to the Greens list with this candidate. (Hannah)
*Lisa Butterfield was elected by a narrow margin to the Coop Board of Directors. There was a 4.1% voter turnout. Martha also let us know about the live lobster tank and is part of the Lobster Rescue Brigade. Oct 29th, 3-6pm, Eka Coop is the next annual meeting, opportunity to speak to the board about anything.
*Eileen McGee asked Dana to represent the Greens on KHSU (90.1FM) Thursday Night Talk in a discussion about the state propositions. Patrick Riggs (Dems) and someone from the Republicans will be on too. Send Dana any information you have about the propositions, and everyone is welcome to call in that night.

We will ask David Giarrizzo to turn over the domain EurekaGreens.org. Heidi will build us a website and Kaitlin will administer it with her, until our next meeting when we appoint a new official web administrator. Hannah is willing to help if they need it, Dana can help with linking it to the GPHC.

EUREKA GREENS ANNOUNCE ENDORSEMENTS FOR STATE
INITIATIVES AND CITY
COUNCIL RACES

EUREKA - The Eureka Greens, a local chapter of the
Green Party of Humboldt County, announced their endorsements for
the November election on Tuesday. The group is urging voters to
vote yes on state propositions 84, 87 and 89. "The Green Party is
committed to protecting the environment. Proposition 84 is an
important measures to protect our waterways and parks, and Prop 87 is
crucial to developing alternative energy sources and solutions
to the environmental and social problems caused by global
warming. We need to decrease our dependence on unsustainable
resources like oil, and Prop 87 is a step in that direction," said Heidi
Calton, Chair of the Eureka Greens and one of the Spokespersons
( Xandra Manns and David Giarrizzo being the others ) for the group.

"Proposition 89 is a crucial measure to regain
integrity in the electoral process. The majority of citizens have
lost faith in their own elections, so it is imperative that we take
action to get big money out of politics. Publicly funded elections
have proven successful in Maine and Arizona, and the people of
California deserve the opportunity to vote for candidates not beholden
to big money from private interests. As a society we fund the
infrastructure of our transportation systems, it is time that we invest
public money in the infrastructure of our democracy - elections," she
said.

The group also announced their opposition to
Propositions 85 and 90. "The Green Party supports a woman's right to choose,
the so-called 'parental notification' measure is an attempt to
obstruct a woman's right to an abortion. A nearly identical measure was
already been voted down by the people of California," Calton
said.

Proposition 90 is a controversial measure that many
argue would do away with local government's right to apply zoning
rules in cities and counties. "Prop 90 is a radical measure that
will take away our collective right to local control over our
communities. Local government needs the ability to make zoning laws to
protect the health and well-being of our communities. If 90
passes it will have a devastating effect on communities like Humboldt
County. We stand to lose our right to keep the rural aspects and
small-town feel of our communities, the Green Party is very opposed to this
measure and we hope the voters of California stand up for community
protection by voting no on 90," said Calton.

The chapter has endorsed Mayor Peter LaVallee in his
bid for re- election and threw their support behind Eureka City
Council candidates Larry Glass, Ron Kuhnel and Nancy Abrams.
The group decided not to endorse either candidate for the 4th
District Supervisors seat.

The Eureka Greens regularly meet the third Saturday
of every month at 3:30pm at Has Beans Coffeeshop on I Street in
Eureka. Their next meeting will be November 18. More information about

Charles Douglas, Come Forth!

Charles Douglas has been an intergral part of the Green Party in years past. He follows the Ten Key Values and when he was part of the Steering Committee he wrote many proposals and resolutions, often not taking credit he was due for his arderous attempts to guide others to a better way of comunicating political thoughts.

Unfortunately, Charles fancies himself a journalist, not a political figure, so he takes his shots from the sideline often at the eleventh hour. I really wish he would come foward and get into the thick of it rather than skirting about and allegedly offering resolutions anynonomously without elaborating on them in only the articulate way he can.

You belong in the ring kid!

IX. POLICE REVIEW
1. Xandra has petitions – deadline was missed for the Nov. ballot, option is still available for a special election.

2. Hannah suggested perhaps a “Citizen’s Cop Watch” instead of Police Review Commission.

3. Police Review Coalition is still collecting signatures to try for a special election. The deadline is in October. Xandra still has petitions, if people would like to help they should contact her. She will bring them to the next meeting.

4. Perhaps the better option would be to collect the signatures and bring them to the City Council to pressure them to vote for it without having to trigger a special election.

5. One idea – submit videos of police misconduct on cable access (this was David G’s idea).

EUREKA GREENS ENDORSE CANDIDATES FOR EUREKA CITY COUNCIL RACES

EUREKA - At a well attended meeting last night, the Eureka Green Party
Local voted to endorse candidates in the Eureka City Council and Mayor
races. The group unanimously endorsed Peter LaVallee for Mayor and
Larry Glass, Ron Kuhnel and Nan Abrams for City Council in the upcoming
November election.

"These candidates are standing up for the people of Eureka," said Heidi
Calton, Chair of the Eureka Greens. "They have a commitment to the
environment, social justice, open government and citizen participation.
These are some of the values they have in common with the Greens Party,
and we're pleased that they have stepped up to serve the citizens of
this town."

Over the course of the meeting, participants expressed frustration with
the current City Council and their lack of leadership and
accountability. "Eureka is at a crossroads and we need visionary
leaders, Mayor LaVallee has served Eureka well, but we need to see a
change on the Council," said Calton. "Our elected representatives
should welcome public comment and participation."

Topics discussed at the meeting included neighborhood associations,
civil unions for same sex partners, slum landlords, drug use and crime,
instant runoff voting, the Balloon Track, citizen involvement in the
City process and the pulp mill.

All candidates were invited to the meeting. Other candidates in
attendance included Mary Beth Wolford and Tish Wilburn. Wolford had to
leave before she was able to field any questions. The Eureka Greens
will consider the 4th District Supervisor's race at their next meeting.

The group also unanimously voted to elect Jared Wilken to serve as the
Eureka Delegate on the Green Party of Humboldt County Steering
Committee.

Open Letter to the Humboldt Green Party

I think you are deluding yourself if you think the aggression has ceased in our party. I feel much hostility still from some of our members who feel it is necessary to berate, prod, and antagonize other board members with short, curt displays of intolerance and belittling. I, for one, have had enough of the Steering Committee and the shame it has caused the party with all the power grabbing and disrespect it has shown.

Without a measure or an election, the party moves at a slugs pace. There is very little commitment outside of special interests and immediate rewriting and undoing of any progress that had occurred previous to this current Steering Committee. It's enough to turn someone away from registering Green.

Since you and the "Grandstanding Greens" have decided to mow your way through, I will step out of your way and concede my position as Eureka Rep.

I am sure this pleases you to no end, as I have obviously been a distraction and an unwelcome member from the start. Someone will be elected at the next Eureka Greens meeting, hopefully, and someone other than David Cobb and his protegees will take this spot and bridge some understanding between the differing politics of our schismed band of rebels.

Here's one last suggestion. Try encompassing local issues and make some change at a grass roots level. You will have more impact if you are addressing problems closer to home. Its the Green Party, not the U.N. You can shout and protest the war till you are blue in the face, but that wont help the locals and their immediate needs for a safer community. Start with the utility companies and their crooked practices.

Think on that while your doing your closing circle.

Tabling Schedule: Jared reported that there was one table left for the 4th of July – He couldn’t get ahold of Heidi until after the event. Jared reported that Eureka Mainstreet said that to table a group needs insurance. Jared will ask the City of Eureka if a permit is needed to table at the Gazebo.

Benefit Concert: see announcement on Eureka Greens website. David G. sent a press release. He handed out posters. Kelly O’Brien’s is letting us use the location for free. Jared offered to help put up posters – will make them black and white. Xandra called Peter Camejo (interested), Donna Warren (interested), Forrest Hill (can’t come), Larry Cafiero (said he would come). Time has been provided for anyone who wants to, to speak. Alexander Cockburn may come as well. Unfortunately we don’t have any bands from So.Hum., they can’t make it.

X. EUREKA GREENS VOTER GUIDE
· We like this idea. After we make endorsements we would like to put together a voter guide. We would like the County to have the candidates night at a meeting to make presentations and the Eureka Greens will then decide who we want to support for the Eureka elections.

XI. REVIEW OF POTENTIAL AMENDMENTS TO LEGISLATIVE AGENDA
· This proposal is something that was proposed last Oct/Nov. The idea is that we would consider a number of policies and determine our support for them, they are on the internet (pbwiki/eurekagreens - password is green) for group discussion. Then we would determine means to get the legislation approved. Green Party Positions – idea is to make handouts for tabling. (Based on tabling sheets Xandra picked up from the San Diegos Greens)
· Proposal: Everyone (Xandra, David G., Paul D., Budd Dickinson, Heidi) who signed up to work on this should go to website and fill your information in. At the next meeting we’ll appoint a subcommittee to move this forward.

"My friend Peggy Martinez called to let me know I have another chance to hear her raggedy country outfit, Donny Barnyard and the Dust Devils, when they play next Wednesday, July 26, at Kelly O'Brien's as part of True Colors, a benefit for the Eureka Greens. I believe David G from The Widdershins put the event together (he's Green all the way). His band is playing, anyway, and he's also recruited singing chef Brett the Truck and songwriter Lisa Sharry. Peggy notes that she will probably be playing drums for everyone but Lisa. BTW, it's also a benefit art show with works by local artists including Blake Reagan and Jordan Wry for sale to benefit the party.

Haven't the local Greens been at each other's throats lately?
Perhaps if they'd just party together a little more the Party would be more harmonious. In fact maybe we could apply that rule internationally. We could all use a bit more partying and a lot less fighting."

I. Announcements
1. Mark requested that the Eureka Greens pass on a suggestion to the Arcata Greens to try to get at-large representation on the Arcata City Council if the city decides to move forward with chartering rather than by wards. He suggested that Eureka's experience with wards has not been entirely successful. Mark agreed to write a letter for us to send. He will send a email a copy to the attendees and we will discuss at our next meeting.

2. Heidi reported that we do not have enough money for the North Country Fair and need to pass the hat. She is pursing an extension with the Fair committee.

II. ELECTIONS:
Secretary - Paul Dillon nominated Kaitlin. Approved by unanimous consensus. Xandra and Hannah offered to help Kailtlin.
Spokesperson - Kaitlin nominated Xandra. Approved by unanimous consensus.

III. Resolution “Condemning County Party Bylaws Violations”:
1. There was much discussion about this item, some of the points raised:
We should not accept anonymous submissions to our agendas - it puts us in a vulnerable position, who knows where this came from and what the author’s true intention is? (Kaitlin)
2. This would be more appropriate to be addressed at the Steering Committee level (Xandra)
3. This resolution is meant to be disruptive and negative. Need to move forward without anonymous attacks (David C.)
4. This resolution raises valid points, some people (named David C.) have been underhanded and manipulative (Paul D.)
5. What is the purpose of a resolution condemning other Greens? (Hannah)
6. We don’t have an adequate understanding of the current (county) bylaws to discuss this resolution (Xandra)
7. This is an issue that should be resolved by the General Assembly - where it started (Kaitlin)
8. The disagreements over Measure T generated a lot of animosity - we need to stop it so that we can move forward productively (David G.)
9. Mark Konkler asked that if this Resolution is approved that the Voter Confidence Committee be taken off as a party to receive it
10. The question was raised as to whether non-Greens should be allowed to talk at these meetings (Paul D.)
11. Without Leo on the Steering Committee we would have no representation from So. Hum. Also, there is much confusion about what happened and what should happen next. (Martha)
12. This is just a big misundertanding. Our bylaws are way too confusing. No ill-will meant by anyone. The press contacted the people who were quoted in recent articles - no one sent out a press release. Personally there is no problem with Martha & Leo serving on the Steering Committee (Kaitlin)
13. The change to the number of Steering Committee members was made at the Steering Committee level and will be addressed there at the next meeting. If no resolution is reached it will go on to the General Assembly (Heidi)
We ran over time on this item. No proposals were made, no action was taken and the Resolution was dropped.

IV. Bylaws Amendments (proposed by David Giarrizzo):
PROPOSAL A: (purpose - to ensure commitment to the Eureka Greens by voting members)
Article III. Membership
Section 2. Active Membership
ADD: 3.2-1 e. Attend at least three General Membership meetings in the past twelve (12) months.
This proposal did not have consensus. The vote was:
4 in favor (Paul D., David G., Heidi, and Xandra)
1 against (David C.)
4 abstentions (Hannah, Jared, Kaitlin, Harold)
This proposal did NOT pass.

A compromise was offered by Jared to change it from three meetings to two. With voting to be allowed at the second meeting.
This proposal did not have consensus. The vote was:
8 in favor (Heidi, David G., David C., Xandra, Paul D., Harold, Jared and Kaitlin)

This proposal DID pass.

Section 4 - Meetings
Change: 4-4.1 The Eureka Greens shall meet at least monthly, on the third Saturday at a time and place chosen by the Chair or a majority of other officers.

CHANGE: 4-4.3 The meeting requires a quorum to take action on any proposal under its consideration. A quorum for the Eureka Greens shall consist of at least a simple majority of ten or more active members.
This proposal was withdrawn.

CHANGE: 4-4.5 A special meeting may be called by the Chair or by submission to the Secretary of a petition signed by 20 active members of the Eureka Greens, accompanied by the agenda of the meeting.

We ended this agenda item before we were done because we were over time. The following items were postponed until our next meeting:

Section 5 - Decision-making Process
CHANGE: 4-5.6 Any officer may exercise the right to exclude an individual who fails to honor the process and principles of the Green Party. With consensus (three-fourths majority fall-back votes), the General Membership Meeting may ratify this action if a written appeal is made at least three (3) days prior to the meeting.

Section 7 - Endorsements
CHANGE: 4-7.1 The General Membership Meeting reserves the right to make endorsements of candidates for public office on behalf of the Eureka Greens irrespective of any endorsements decisions reached by the GPHC or the GPCA. Preference should be given to candidates who are registered with the Green Party of California, and the stability and growth in the number and quality of Greens holding office shall be an ongoing concern.

Article V. Ratification and Amendment of Bylaws
Section 2 - Amendment Procedure
CHANGE: 5-2.1 Any proposed amendment to these Bylaws shall be submitted in electronic format the Secretary for review with no less than 14 days notice. Upon review an amendment may be considered at a regular meeting if included on the published agenda. An amendment shall take effect immediately upon the consensus or three-fourths majority vote by the General Membership Meeting of the Eureka Greens.

V. Fundraising Efforts
A. Block Party: Same time as Farmer’s Market in the Henderson Center neighborhood (near where Heidi lives). She will talk to her neighbors and give us an update at the next meeting. Backup would be in Xandra’s neighborhood.

B. (added) Garage Sale: Want to do this when the students get back (end of Aug/early Sept). Also would be good to do this in conjunction with the Farmer’s Market. Perhaps it could be rolled into the Block Party too? Heidi will talk with her neighbors about this idea. She will also look into somewhere to store the items in the weeks before the sale.

C. Tabling Schedule: Jared will contact the City of Eureka to find out if there are restrictions on tabling at Farmer’s Markets and Arts Alive. He will also contact Main Street to see if there is still room to table at the 4th of July event.

D. Tabling Materials: Heidi has these at her house. If anyone wants to table they should contact her. 834-1978.

E. Benefit Concert: David G. is the point person on this. He is looking at organizing something for July 26th. Venue options discussed were the Women’s Club and the Mateel. Also talked about doing an exchange with So. Hum bands and perhaps linking this to a gulch cleanup or Scotch Broom clearing party.

Article I. Name & Affiliation
Section 1 - Name
1-1.1 The name of this organization is the Eureka Greens. The governing body of the Eureka Greens shall be the General Membership Meeting of the Eureka Greens.

Section 2 - Affiliation
1-2.1 The Eureka Greens are an affiliated Local of the Green Party of Humboldt County if legally recognized by and in compliance with the County General Assembly.

Article II. Mission & Purpose
Section 1 - Mission
2-1.1 The mission of the Eureka Greens shall be to promote the 10 Key Values of the Green Party of California in the area around the City of Eureka and the townships of Myrtletown, Pine Hill, Humboldt Hill, Cutten and Samoa as a Local of the Green Party of Humboldt County.

Section 2 - Purpose
2-2.1 These bylaws shall govern the organization, operation and functions of that political organization known as the Eureka Greens and they will also govern the General Membership Meeting of Eureka Greens and any committees established thereof. At no time may these bylaws or any operation of the Eureka Greens be in conflict with the bylaws and policies of the Green Party of Humboldt County.

Article III. Membership
Section 1 - Eureka Greens
3-1.1 All persons registered to vote within the City of Eureka or the townships of Myrtletown, Pine Hill, Humboldt Hill, Cutten or Samoa, as members of the Green Party pursuant to the laws of the State of California are eligible to participate in the functions of the Eureka Greens as provided by the laws of the state of California and these bylaws. Persons not eligible to be registered to vote in the State of California may participate in the functions of Eureka Greens so long as they meet all requirements of active membership.

Section 2 - Active Membership
3-2.1 Active members of the Eureka Greens shall be considered those who meet all the following requirements:
a. Adhere to the 10 Key Values of the Green Party of California.
b. Support the platform of the Green Party of California and be guided by the platform in official Eureka Greens presentations to the public.
c. Participate in the work of the Eureka Greens.
d. Be registered Green if eligible under California law.
e. Attend at least two (2) General Membership Meetings in their entirety in the past twelve (12) months.

Article IV. The General Membership Meeting
Section 1 - Mission & Purpose
4-1.1 The General Membership Meeting shall serve as the governing body of the Eureka Greens. The meeting’s mission is to contribute to the ongoing empowerment of the members of the Eureka Greens so that they may continue their work. In keeping with the principles of grass-roots democracy, the meeting will serve to promote the 10 Key Values of the Green Party of California in all its actions and statements.

Section 2 - Duties & Authority
4-2.1 Those officers and appointees duly authorized by the will of the General Membership may perform tasks such as the following:
a. Act as necessary (while adhering to the process and principles of the Green Party of California) to carry out the decisions of the meeting and make executive decisions (but not set policy) between meetings. Actions between meetings shall reflect decisions made at announced meetings.
b. May make statements and authorize in the name of the Eureka Greens consistent with local, county and state policy.
c. The Eureka Greens shall refer all matters of law and legislation to the County Legal Committee. This includes undertaking any legal action deemed necessary to make decisions.
d. Conduct campaigns for the Eureka Greens and its candidates for public office.
e. Empower committees approved by the meeting.
g. Employ staff as necessary or desirable.
h. Conduct such other business as the Eureka Greens may require.
i. The Eureka Greens shall refer all disputes between members to the County Mediation Committee. Should mediation fail, the County Steering Committee may resolve the dispute. Either party may appeal the decision to the County General Assembly.
4-2.2 Those duly authorized shall ensure timely distribution of relevant information to all members of the Eureka Greens. This includes, but is not limited to:
a. Upcoming events, including the next General Membership Meeting, and deadlines required by law;
b. Upcoming issues requiring study, thought, and/or action;
c. Updates on projects in progress; and
d. Records or minutes of past meetings or significant discussion involving Eureka Greens.
4-2.3 Information provided to non-members must reflect the decisions of the Eureka Greens.
4-2.4 Use of the voter registration list of Green Party members is strictly limited to activities and persons specifically permitted by the County Steering Committee.
4-2.5 Elections for officers and other appointees shall be conducted consistent with the Bylaws of the Green Party of Humboldt County and, for clarity, with the Green Party of California.

Section 3 - Officers
4-3.1. As its first order of business after the adoption of these bylaws and at the first meeting of every July thereafter, the General Membership Meeting will elect a Local Delegate from among its members.
a. The Local Delegate shall represent the Eureka Greens as a voting member of the County Steering Committee.
b. The Local Delegate shall keep members informed of information shared at County Steering Committee meetings and Emerald Regional meetings of pertinence to the Local.
c. The Local Delegate shall serve a maximum of two complete, uninterrupted terms of one year. A partial term served to replace a former Local Delegate shall not be computed in this limit.
4-3.2 As its second order of business after the adoption of these bylaws and at the first meeting of every July thereafter, the General Membership Meeting will elect a Chair from among its members.
a. The Chair will, along with the Treasurer, sign all checks drawn of the Eureka Greens account.
b. The Chair shall serve as a standing Spokesperson for the Eureka Greens along with others chosen by a General Membership Meeting.
c. The Chair shall produce a published agenda for each regular General Membership Meeting, and may call special meetings and publish their agendas.
d. The Chair shall open General Membership meetings at the appointed time after having ascertained that a quorum is present, and adjourning them when appropriate.
e. Authenticating with their signature all Position Papers, Policy Statements, or other documents as directed by the General Membership.
f. The Chair shall serve a maximum of one complete, uninterrupted term of one year. A partial term served to replace a former Chair shall not be computed in this limit.
g. In the event of the incapacity, resignation or recall of the Local Delegate, the Chair shall serve as interim Local Delegate until the meeting elects one.
4-3.3 As its third order of business after the adoption of these bylaws and at the first meeting of every July thereafter, the General Membership Meeting will elect a Vice Chair from among its members.
a. In the event of the incapacity, resignation or recall of the Chair, the Vice Chair shall serve as interim Chair until the meeting elects one.
b. In the event of the incapacity, resignation or recall of the Secretary, the Vice Chair shall serve as interim Secretary until the meeting elects one.
c. In the event of the incapacity, resignation or recall of the Treasurer, the Vice Chair shall serve as interim Treasurer until the meeting elects one.
d. The Vice Chair shall represent the Eureka Greens in official communications with the organs, committees and officials of the Green Party of the United States and the Green Party of California, as well as with the Greens for Democracy and Independence (GDI) Caucus and with the Global Green Coordination.
e. The Vice Chair shall serve a maximum of two complete, uninterrupted terms of one year. Partial terms served to replace a former Vice Chair shall not be computed in this limit.
4-3.4 As its fourth order of business after the adoption of these bylaws and at the first meeting of every July thereafter, the General Membership Meeting will elect a Treasurer from among its members.
a. The Treasurer shall provide the meeting with written reports of all transactions during the proceeding month.
b. The Treasurer shall be responsible for fulfilling all the requirements of the Political Reform Act and FPPC.
c. The Treasurer shall serve a maximum of two complete, uninterrupted terms of one year. Partial terms served to replace a former Treasurer shall not be computed in this limit.
d. The Treasurer is responsible for keeping accurate records of all fund’s at the meeting’s disposal, including the origin of the funds, the balance on hand, money spent, upcoming spending plans, and future funding needs. These records will be available to any member of the Eureka Greens at each meeting. The Treasurer must also grant requests, in a timely fashion, by party members for examination of the records outside of the meeting.
4-3.5 As its fifth order of business after the adoption of these bylaws and at the first meeting of every July thereafter, the General Membership Meeting will elect a Secretary from among its members.
a. The Secretary shall take written minutes of all meetings. Minutes shall be distributed to members before the start of the next meeting.
b. The Secretary will act as a conduit for all reports.
c. The Secretary shall serve a maximum of two complete, uninterrupted terms of one year. Partial terms served to replace a former Secretary shall not be computed in this limit.
d. Minutes of the preceding meeting will be available to any member of the Eureka Greens at meetings.

Section 4 - Meetings
4-4.1 The Eureka Greens shall meet at least monthly, on the third Saturday at a time and place chosen by the Chair or a majority of other officers.
4-4.2 All active members of the Eureka Greens may participate in the “consensus-seeking process.”
4-4.3 The meeting requires a quorum to take action on any proposal under its consideration. A quorum for the Eureka Greens shall consist of at least a simple majority of five or more active members.
4-4.4 The regular monthly meeting shall be publicized with no less than seven days advance notice of its time, date, location and agenda, with no less than three days advance notice of any special meeting. Advance notice shall consist of communicating the time and place of this meeting and its agenda by directing the County Media Committee to advertise the meeting as widely as realistic.
4-4.5 A special meeting may be called by the Chair or by submission to the Secretary of a petition signed by 20 active members of the Eureka Greens, accompanied by the agenda of the meeting.

Section 5 - Decision-making Process
4-5.1 The Eureka Greens shall follow the “consensus-seeking process” for reaching decisions as outlined in the Bylaws of the Green Party of California.
4-5.2 Notwithstanding other provision of these bylaws, once the membership has ratified the agenda contract, requests for additional agenda time for an item must include a specific number of minutes and whether the time will be added to the length of the meeting or if it will come from some other item. The meeting must reach consensus (two-thirds majority vote fallback) to contract for additional time or to add an item to the agenda subsequent to its publication by the Chair or a petitioner.
4-5.3 When the closing option of voting is selected by the presenter of the proposal, the facilitation team will proceed in the following steps:
a. The note taker will read the proposal and amendments.
b. The scribe will record the vote of the General Membership Meeting where all can see it by “yes”, “no”, and “stand- aside.”
c. If necessary, the facilitation team will call a roll and record each member with the help of the door keeper.
d. Stand-asides are not counted in calculating the percentage vote, however if those who stand-aside represent a plurality of the vote, the proposal fails.
e. The role call recorded vote will be included in the meeting minutes.
f. Only active members may vote or hold an unresolved concern.
g. The Secretary shall make available written copies of any action item duly circulated and placed on the agenda by the Chair of by a petitioner. Any item not circulated prior to the General Membership Meeting must be presented in legible form with at least 15 copies provided by the particular presenter(s) of an item.
4-5.4· Eureka Greens meetings are public and open to observers. Guests and observers will register with the doorkeeper.
4-5.5 The General Membership Meeting may choose to go into closed session with a three-fourths majority vote. Only active Eureka Greens members may attend closed sessions.
4-5.6 With consensus (three-fourths majority fall-back vote), the General Membership Meeting may exercise its right to exclude an individual who fails to honor the process and principles of the Green Party.

Section 6 - Recall & Removal
4-6.1 The following steps are necessary to enact the recall of an officer or appointee:
a. Three active members of the Eureka Greens must present a written statement to the meeting specifying exactly how the member failed to act in accordance with the 10 Key Values or with these bylaws.
b. Both parties will meet with the County Mediation Committee within fourteen days. Within five days the County Mediation Committee will inform both parties of its recommendation.
c. If either party is dissatisfied with the County Mediation committee’s recommendation, the meeting shall allot equal times for both the officer targeted for recall and the party attempting the recall to present their positions. If the meeting reaches consensus (two-thirds majority fallback vote), the officer shall be considered removed.
4-6.2 Any officer shall be considered removed if they fail to attend three consecutive General Membership meetings, whether regular or special.

Section 7 - Endorsements
4-7.1 The General Membership Meeting reserves the right to make endorsements of candidates for public office on behalf of the Eureka Greens. Preference should be given to candidates who are registered with the Green Party of California, and the stability and growth in the number and quality of Greens holding office shall be an ongoing concern.
4-7.2 Endorsements of multiple candidates for a particular office beyond the number of seats available are not permitted. No candidates from the Democratic or Republican parties may be endorsed for partisan office if other options exist.
4-7.3 Candidates shall be eligible for endorsement for each office based on their adherence to the Ten Key Values and state and local Green Party platforms and policies. Candidates may only be considered at the direction of the County Elections Committee, or by submission of written communiqué by the candidate to the Secretary, or by attendance at the General Membership Meeting wherein the endorsement is made.
4-7.4 Each active Eureka Greens member present may cast a ballot on endorsements for all offices under consideration in a particular election cycle. Ranked Choice Voting (also known as instant Runoff Voting) shall be used to determine the outcome, which shall include the option of "No other Candidate (NOC)," also known as None of the Above. Candidates shall be endorsed upon receiving first round or transferred votes beyond the necessary threshold. No candidate receiving fewer first-round or transferred votes than the NOC option shall be endorsed.

Article V. Ratification and Amendment of Bylaws
Section 1 - Ratification
5-1.1 These Bylaws are ratified and shall take effect immediately upon the consensus or three-fourths majority vote by the General Membership Meeting of the Eureka Greens.

Section 2 - Amendment Procedure
5-2.1 Any proposed amendment to these Bylaws shall be submitted in electronic format to the County Legal Committee for review with no less than 14 days notice. Upon review, an amendment may be considered at a regular meeting if included on the published agenda. An amendment shall take effect immediately upon the consensus or three-fourths majority vote by the General Membership Meeting of the Eureka Greens.

Article VI. General Policies
Section 1 - Discrimination
6-1.1 The Eureka Greens shall not discriminate on the basis of age, race, sex, sexual orientation, physical ability, religion or income. It is the responsibility of officers to insure that this policy is carried out.

Resolution Concerning the Proper Conduct of Voter Registration Efforts

Whereas, Efforts to register voters to join the Green Party were undertaken at the Godwit Days Festival and at the Sustainable Living, Arts and Music Festival in April under the direction of GPHC Steering Committee member Shaye Harty and Arcata Greens Vice Chair Fhyre Phoenix; and

Whereas, These efforts resulted in the submission to the Humboldt County Elections Division by Shaye Harty of 135 voter registration cards on behalf of Humboldt County residents who wished to join the Green Party; and

Whereas, According to Humboldt County Elections Manager Lindsey McWilliams, 92%, or 124 of the 135 voter registration cards submitted by Shaye Harty were invalid due to serious errors or omissions in required voter information, or due to the lack of signature from the person or persons helping voters fill out the forms, a violation of state election law; and

Whereas, This is the first time the GPHC has ever been contacted by the elections department regarding such a flagrant failure to comply with basic voter registration standards; and

Whereas, At the GPHC Steering Committee meeting of April 25, 2006, Shaye Harty was confronted with these facts and apologized to all present; and

Whereas, Shaye Harty also agreed to a unanimously adopted motion of the Steering Committee to rectify these matters by working with county elections to track down and re-register these voters, as well as reporting to Steering Committee members on a twice-weekly basis on the progress of these reparations; and

Whereas, Shaye Harty and Fhyre Phoenix failed to contact any members of the Steering Committee at any time since April 25 regarding any updates to her reparation efforts; and

Whereas, These activities constitute a serious breach of the standards and practices of the Green Party and a public embarrassment to the ongoing program to reach and register more Humboldt County residents into the Green Party. Therefore be it

Resolved, The Eureka Greens condemn the violation of state election law by Shaye Harty and Fhyre Phoenix in failing to sign voter registration forms they assisted in the completion of. Be it further

Resolved, The Secretary or other competent officer shall submit a complaint to the California Fair Political Practices Commission (FPPC) regarding theis violation of state election law by Shaye Harty and Fhyre Phoenix. Be it further

Resolved, The Eureka Greens urge members to consider the recall of these individuals from their seats on the Steering Committee and the Arcata Greens. Be it further

Resolved, The Secretary shall transmit this resolution to the GPHC General Assembly and all other GPHC Locals, the Emerald Regional Representatives and all constituent county organizations, the GPCA State Coordinating Committee and Electoral Reform Working Group, County Clerk Carolyn Crnich, Elections Office Manager Lindsey McWilliams, the FPPC, all members of the Humboldt County Board of Supervisors and Humboldt County Election Advisory Committee, the Voter Confidence Committee, Humboldt Voter’s Association, League of Women Voters of Humboldt County and all local media.

Whereas, A slate of six candidates (Hannah Clapsadle, Dana Silvernale, James Aaron Busald, Budd Dickinson, Shaye Harty, Alice Woodworth) for election to the Steering Committee of the Green Party of Humboldt County has formed under the banner of “Go Green Humboldt;” and

Whereas, These candidates by their own admission sent out a mass mailing to all registered Greens in Humboldt County, which contained inappropriate assertions regarding the activities of the Green Party of Humboldt County, such as a lack of utilization and communication with Green Party members, along with statements urging the election of the Go Green Humboldt slate to the exclusion of other candidates; and

Whereas, No attempt was made to contact any of the other four candidates as to whether they wished for their information to be included in the mailing, despite claims of “unity” and “inclusiveness” to the contrary; and

Whereas, This mass mailing by Go Green Humboldt constitutes election-related spending on behalf of a group of candidates, which under California law triggers the required filing of Form 410 informing the public of the existence of the Go Green Humboldt committee; and

Whereas, Whether through direct spending, in-kind donations or a combination of both, this mass mailing appears likely to have broken the threshold of $1,000, requiring further filing of Form 460 detailing the source of contributions to this mailing; and

Whereas, These failures to file the required election-related disclosures constitute violations of the California Political Reform Act and of other particular laws. Therefore be it

Resolved, The Eureka Greens condemn the violation of state election law by Hannah Clapsadle, Dana Silvernale, James Aaron Busald, Budd Dickinson, Shaye Harty and Alice Woodworth, who constitute the Go Green Humboldt committee, possibly along with other unknown individuals. Be it further

Resolved, The Secretary or other competent officer shall submit a complaint to the California Fair Political Practices Commission (FPPC) regarding these violations of state election law by the Go Green Humboldt committee and by these candidates. Be it further

Resolved, The Eureka Greens call for full disclosure of all expenditures and donations towards its campaign. Be it further

Resolved, The Eureka Greens urge members to consider the recall of these individuals from their seats on the Steering Committee (if elected) if their full disclosure are not forthcoming. Be it further

It's time to set the Green record straight

A Working Person's Perspective

I’m glad to be able to set Fortuna resident Michael Smith straight on his many errors, and I will continue to do so until he tires of his campaign to disable the Eureka Greens.

Why is Michael Smith listed as writing “A Working Person’s Perspective” when the man is unemployed? His main profession, beyond his sporadic enrollment in various colleges, is to disrupt the Green Party much like his fellow Texan, David Cobb.

Cobb’s roll in damaging the Green Party is renowned, including the loss of strong Green parties in several states following his divisive and disastrous 2004 theft of our presidential nomination from Ralph Nader and Peter Camejo.

After losing all his positions in the California and the U.S. Green Party, all David Cobb has left to kick around is the local Green Party, and we’ve made it clear we won’t be bullied or misrepresented without a struggle.

As part of our campaign to stand up for Green values, we have considered the role of media carefully. Although my resolution utilized earlier ideas brought up by others, it was still my resolution and the Eureka Greens still approved it unanimously. Its part of our consensus-seeking process to build off of the good ideas of fellow activists, for the point is to create positive change, not to take the credit for it.

The only “faking” going on here is Michael Smith’s incessant attempts to falsify the history of the local Green Party to further his takeover schemes.

Michael Smith’s memory doesn’t even extend to meetings he was a guest at. If he had actually read any of the materials I provided copies of at a recent steering committee, he would have noticed the Oct. 25, 2005, minutes which we approved. These minutes clearly note the 6-0 vote to elect me secretary as well as to elect Smith’s political operative, Jesse Goplen, as treasurer.

Of course the difference is clear, since I’ve made a good-faith effort to do my job while Goplen has yet to come up with a single monthly treasurer’s report in nearly half a year.

Smith doesn’t seem to understand the role of secretary. My job is to write the minutes for steering committee meetings — not to sacrifice my career and social life to be the note-taker at every single general assembly, local and subcommittee meeting.

I wasn’t at the recent general assemblies because I work for a living. I am a volunteer and I serve for the love of Green values with the time I have available. With few of the responsibilities the rest of us adults must endure, Smith has ample time to revel in his delusions.

The pattern of Smith and the co-signers of his Green coup d’etat against our elected representatives is to neglect their duties, blame others for their inaction, then attempt a purge of anyone who dares to differ.

I still haven’t seen any evidence of the “new” Arcata Greens under Shaye Harty and Fhyre Phoenix accomplishing anything besides their doomed attempt to annex half the county into their territory. What sane, self-respecting person would consider Arcata as a “local” meeting for a Green living in McKinleyville, Orick or Willow Creek? Planet Arcata?

Eureka Greens won’t take over Fortuna, Ferndale or any other far-flung communities. Of course, we always welcome Green members to our meetings, as long as they behave as guests and not agenda-setters.

Instead of playing games with the limited time and energies available to progressive activists in this county, we’re taking our role seriously.

Our campaigns for police review, sustainable housing, transportation and development and progressive candidates will keep going and keep growing.

That’s why your recall against Greg Allen failed miserably, Michael. You’re out of touch with the longtime members of this community, as is your fellow Texan, David Cobb. You think you can manipulate the media, but I think the media will be your undoing.

As the Beatles put it, “Get back to where you once belonged.”

Eureka Greens Back Opposition to Measure T

Balloon Track vote, Marks and Gallegos all endorsed

Resolutions adopted to oppose use of Diebold machines in local elections
and support clean elections between competing Greens

After nearly six months of impassioned debate from a diverse range of perspectives, the Eureka Greens unanimously agreed on Saturday to back opposition to Measure T, the initiative on the June ballot which would strip political rights from any corporation defined as “non-local.” The Eureka Greens were already on record since January 21 in support of the Humboldt Campaign Contribution Limitation Ordinance, which would limit contributions from any source for or against a particular candidate or their recall to $500.

An equal amount of exuberance in the opposite direction was apparent for the Eureka Waterfront Approval Ordinance, which received an affirmative endorsement without a single dissenter. The initiative has just entered circulation and several Eureka Greens members have already signed the petition to get it on the November ballot.

“I think the people should have a say over what happens on that land because any development on that land will affect our water,” Eureka Greens Chair Heidi Calton said. “The development has to be done properly.”

Endorsements were also issued in support of incumbent District Attorney Paul Gallegos in his re-election bid, as well as Richard Marks in a three-way race for 4^th District Supervisor.

“I think it’s indicative of our maturity as a party to see the distinction between a pulp mill we have environmental concerns with and the workers who need living wage jobs,” Eureka Greens Local Delegate David Giarrizzo said. “I’m glad we can support a progressive candidate for Supervisor like Richard Marks, especially since he has such strong credentials with organized labor.”

In addition to the election of Manns as the new Vice Chair and further development of the Eureka Greens Legislative Agenda, two resolutions were approved regarding voting conduct. The Resolution Regarding the Use of Diebold in Local Elections calls for the use of hand-counted paper ballots instead of the vote tabulation machines maintained by the controversial corporation, while the Resolution Regarding Green Party Primary Elections asks all Green candidates to abide to clean election standards and to give back to their party once elected.

“It’s encouraging that we’re coming along so well and actually making a difference on these issues,” Eureka Greens Vice Chair Xandra Manns said.

Both resolutions will move forward for consideration by the General Assembly of all Green Party members in Humboldt County, to take place next Saturday at Humboldt State University. The next Eureka Greens meeting will be on May 20, 5:00 p.m.

Readers deserve to know the truth behind the lies printed in Thursday’s Eureka Reporter about the Green Party.

For starters, why is a former Arcata Eye editor, Rebecca S. Bender, writing in an objective style about a “so-called” Green Party resolution, when this document directly addressed the paper she was running at the time?

She completely mixed up the activities of the Green Party of Humboldt County itself and its autonomous locals, the Arcata Greens and the Eureka Greens. “Fair and balanced” indeed!

As a matter of record, the Eureka Greens adopted the Resolution to Promote Responsible Journalism and Scrutinize Biased Media, not the Green Party, which opted to send a letter instead. Greg Allen didn’t write the resolution; I did!

It is the responsibility of the steering committee to make all proposals considered by General Assembly available for review before the meeting. To criticize Greg Allen or anyone else merely for making information accessible is to condemn them for doing their job.

Considering controversial ideas is not a crime in itself and I question the motives of Michael Smith in trying to stifle dissent, especially after he has been given ample opportunity at several meetings of the Eureka Greens, the steering committee and the General Assembly to make his views known.

It just so happens that the concerns in the media bias resolution were proven correct. Our follow-up Resolution to Condemn Abusive Communications was unanimously approved by both the Eureka Greens and the Green Party. Our party has united in support of the responsible use of freedom of the press and we look forward to co-sponsoring a conference on media reform later this year.

The Green Party has also never issued a news release regarding Measure T; that was the Arcata Greens. Although they later met to change their position, this does nothing to impugn the validity of the earlier release, which was determined at a publicly noticed and properly attended meeting. It was lawful under the same rules that we use in the Eureka Greens. What is Ms. Bender’s agenda in light of this disregard of the facts?

... In 2004 we had no local organizations, no outreach program and little in the way of communications with our members or the greater community. Thanks to Greg, many new activists (myself included) have come on board, chapters have formed in Arcata and Eureka, our police review initiatives are going into circulation and our party registration is growing again thanks in part to an organizing plan written by Allen. Our party has gone from zero public presence to a good degree of positive press as we become increasingly involved in public concerns.

Greg doesn’t deserve this smear job. ... He deserves a medal for his countless efforts to bring this party back from the dead, which is where we were before Allen came on board. The values of transparency and grass-roots democracy which Allen has strengthened have, ironically, made us vulnerable to this hostile takeover. I trust Greens will resist this purge and continue to respect diversity and free speech within our party.

Voter Confidence Resolution

Whereas, An election is a competition for the privilege of representing the people; and

Whereas, Each voter is entitled to cast a single ballot to record his or her preferences for representation; and

Whereas, The records of individual votes are the basis for counting and potentially re-counting a collective total and declaring a winner; and

Whereas, An election's outcome is a matter of public record, based on a finite collection of immutable smaller records; and

Whereas, A properly functioning election system should produce unanimous agreement about the results indicated by a fixed set of unchanging records; and

Whereas, Recent U.S. federal elections have been conducted under conditions that have not produced unanimous agreement about the outcome; and

Whereas, Future U.S. federal elections cannot possibly produce unanimous agreement as long as any condition permits an inconclusive count or re-count of votes; and

Whereas, Inconclusive counts and re-counts have occurred during recent U.S. federal elections due in part to electronic voting devices that do not produce a paper record of votes to be re -counted if necessary; and

Whereas, Inconclusive results have also been caused by election machines losing data, producing negative vote totals, showing more votes than there are registered voters, and persistently and automatically swapping a voter's vote from his or her chosen candidate to an opponent; and

Whereas, Inconclusive results make it impossible to measure the will of the people in their preferences for representation; and

Whereas, The Declaration of Independence refers to the Consent of the Governed as the self-evident truth from which Government derives "just Power." Therefore be it

Resolved, Because inconclusive results, by definition, mean that the true outcome of an election cannot be known, there is no basis for confidence in the results reported from U.S. federal elections. Be it further

Resolved, The following is a comprehensive election reform platform likely to ensure conclusive election results and create a basis for confidence in U.S. federal elections:

1) voting processes owned and operated entirely in the public domain, and
2) clean money laws to keep all corporate funds out of campaign financing, and
3) a voter verified paper ballot for every vote cast and additional uniform standards determined by a non-partisan nationally recognized commission, and
4) declaring election day a national holiday, and
5) counting all votes publicly and locally in the presence of citizen witnesses and credentialed members of the media, and
6) equal time provisions to be restored by the media along with a measurable increase in local, public control of the airwaves, and
7) presidential debates containing a minimum of three candidates, run by a non-partisan commission comprised of representatives of publicly owned media outlets, and
8) preferential voting and proportional representation to replace the winner-take-all system for federal elections. Be it further

Resolved, When elections are conducted under conditions that prevent conclusive outcomes, the Consent of the Governed is not being sought. Absent this self-evident source of legitimacy, such Consent is not to be assumed or taken for granted. Be it further

Resolved, The Secretary shall transmit this resolution to the GPHC General Assembly and all GPHC Locals, GPCA State Coordinating Committee and Green Issues Working Group, Emerald Region of the GPCA and constituent county organizations, Voter Confidence Committee, Velvet Revolution, President George W. I read with amusement the accusations by Democrat Stephen Lewis of a “takeover” of his party by the Green Party’s agenda. What struck me as funny was the assertion of an anti-corporate agenda by Greens, who he seems to think are behind the Democracy Unlimited petition against corporate campaign contributions.

I encourage Mr. Lewis, and especially those Democrats on their Central Committee more eager to jump on that initiatives’ bandwagon, to read the Green Party’s platform, which you can find through www.greenhumboldt.org. Our agenda emphasizes greater corporate responsibility, combined with encouraging economic diversity and growing strong communities. Nowhere do we call for abolishing corporations or stripping them of their basic protections under law. Responsible Greens know that most corporations are small businesses, while a minority have gotten out of hand and deserve the attention of law enforcement and the civil courts, not to mention a more vigilant media.

As a matter of fact, the Green Party of Humboldt County’s most recent General Assembly saw a lot of concerns expressed with how the corporate initiative is written. With a clear lack of consensus in the face of considerable opposition, we declined to take any stance on the matter until after it qualifies next year. The Eureka Greens have also seen some pointed questions directed at this measures’ backers and will again at our next meeting on Saturday Nov. 19 at 5 p.m. As always, we will gather at Has Beans Coffee where all are welcome to join in the discussion.

Local Greens are also considering an alternative initiative which would equally limit all contributions directed at candidates or recall elections to $500, no matter the source. We don’t have to be anti-corporate to support common sense campaign finance reform. I hope we will endorse this alternative at our General Assembly on Saturday Dec. 3, when our meeting of all Green Party members comes back to Eureka.

While his jokes played on the local media wore thin, Mr. Lewis went on in his opinion column last Sunday to spread even more inaccuracies about the Greens. He should come forward with any documentation of a “campaign coordinator” for the Green Party of Humboldt County, because I can find none. It even turns out that Michael Twombly, whom I’ve never seen at a Green Party meeting, isn’t on our most recent roster of voters provided by the county elections office. I’ve never even met him, although I did notice him on HCTV Channel 12 where he was promoting the Local Solutions PAC.

I encourage you to read the newsletter Local Solutions puts out. In a copy I found at a local café, it lists their endorsed candidates, along with markers for those also endorsed by the Democrats and meeting details for their Central Committee. If the Greens had equal say in this PAC, wouldn’t our endorsements and our meetings be listed? These people have never contacted me or anyone else in the Eureka Greens, so this conspiracy theory of yours just won’t fly. If anything, the Green message would be more likely to get diluted in such an arrangement. After the complete failure of David Cobb’s safe states strategy, we’re not in a hurry to try that again.

I’d like to see Eureka Reporter staff take the trouble to find out what the local Green perspective is before giving undue credibility to such unfounded accusations. Certainly Patrick Riggs was asked for a response, shouldn’t we be given the same treatment?

As for Mr. Lewis, please consult with us before you assume what our position is and start to resort to Green-scare tactics reminiscent of Joe McCarthy. Our independent perspective just might continue to surprise you.

Legislative Agenda

of the Eureka Greens
a Local of the Green Party of Humboldt County (GPHC) covering Eureka, Myrtletown, Cutten, Pine Hill, Humboldt Hill and Samoa

PREAMBLE:

This Legislative Agenda is intended to provide direction in the tactical goals to be sought by Green activists in Eureka, by outlining the creation, alteration or deletion of policies to further the Ten Key Values and the fundamental rights and dignity of all citizens.

PART 1. GREEN CONTRACT AND BUILDING LAWS

A Green Contract and Building Act shall be promulgated which includes the following provisions:

a. All individuals and businesses bidding on public contracts must present actual total cost estimates prior to the application for CBDG or HOME funding.

b. All actual total cost estimates shall be independently audited for accuracy prior to the application for CBDG or HOME funding.

c. The use of mark-up sessions to allow for cost overruns shall be phased out of use.

d. All individuals and businesses bidding on public construction projects shall provide a performance bond to constrain them to on-time performance and strict adherence to specifications.

e. City staff shall conduct a new review all housing developments and existing neighborhoods to ensure that proper drainage is provided for, that tenant security is assured, that smoke detection and fire alarm equipment is in good working order and that parking is adequate.

f. All housing constructed with the use of grant funds obtained by the City shall contain at least three fire blocks between all upright timbers (except door and window frames), that all such housing have 200 ampere service in armored cable tubing and that all plumbing carry a 50-year guarantee.

g. Contractors shall be permitted to charge no more than cost plus 20% for on-time performance.

h. All new constructions shall be required to account for the creation of a passive solar hot-water system or other comparable arrangement

i. Preference shall be given to unionized firms in city contracts.

j. All individuals and businesses bidding on public construction projects shall be held contractually responsible for any repair or renovation needed on their project if the situation was caused by failure to adhere to specifications for quality construction.

k. All funding obtained through CBDG or HOME shall be dedicated exclusively to the actual construction of the projects so designated.

l. The construction of floating houses and houseboats should be legitimized, encouraged and further developed in scientific studies and real-world projects as an alternative to building on land.

m. Dust thrown off from public and private construction projects around public waterways should be tightly controlled and tested for toxicity.

n. An investigation of the function of and accounting for the City of Eureka water and wastewater systems should be conducted, as well as their relationship with the Humboldt Bay Municipal Water District.

PART 2. MEDICAL CANNABIS RIGHTS

A Patient Protection Act shall be promulgated which includes the following provisions:

a. Medical marijuana patients or their primary caregivers who cultivate medical marijuana in an area within one hundred (100) square feet cumulatively measured by the vegetative canopy of the plants will not be prosecuted.

b. Medical marijuana patients or their primary caregivers who possess three (3) pounds or less of processed usable marijuana will not be prosecuted. Unharvested plants are not to be included in this weight.

c. Medical marijuana patients or their primary caregivers who possess an additional three (3) pounds or less of marijuana products such as tinctures, infusions, oils, and any other marijuana derivatives will not be prosecuted.

d. Medical marijuana patients or their primary caregivers who possess an additional three (3) pounds or less of baked goods and salves will not be prosecuted.

e. No employee of the City shall officially assist or voluntarily cooperate with investigations, interrogations, or arrest procedures, public or clandestine, that would violate the protections for medical marijuana patients or their primary caregivers under, and within provisions of the Compassionate Use Act of 1996 (California Health and Safety Code 11362.5), or of California Health and Safety Code Secs. 11362.7 to 11362.83, or of the Eureka Patient Protection Act.

f. Employees of the City shall promptly notify the City Manager when, in the course of City employment, the following occurs: An employee is contacted by any law enforcement agency and asked to cooperate or assist with an investigation, interrogation, or arrest procedure that would violate the protections for medical marijuana patients or their primary caregivers under, and within provisions of the Compassionate Use Act of 1996 (California Health and Safety Code 11362.5), or of California Health and Safety Code Secs. 11362.7 to 11362.83, or of the Eureka Patient Protection Act. Upon such notification from an employee, or upon such contact directly, the City Manager shall promptly report to the City Council specifying the law enforcement agency seeking cooperation or assistance and the actions requested of the employee.

g. The City shall provide legal defense to any employee who is criminally charged by another entity for his or her actions in compliance with the Compassionate Use Act of 1996 (California Health and Safety Code 11362.5), or with California Health and Safety Code Secs. 11362.7 to 11362.83, or with the Eureka Patient Protection Act.

PART 3. CHARTER REFORM

The movement towards amendments to the Eureka City Charter shall be pursued, to include the following reforms:

a. Direct election of City Manager, City Attorney, City Clerk and Police Chief.

b. Ranked Choice Voting, also known as Instant Runoff Voting, for all City elections.

c. Public financing of all elections for every qualified candidate who raises $500 in contributions from at least 50 donors.

d. A Code of Ethics for elected officeholders, to include standards of decorum and provisions for censure.

e. An increase in the number of City Council seats to nine, and an increase in compensation to a living wage level at part-time.

f. Public comment limited to no less than five minutes, with open public comment time of no less than thirty minutes provided near the beginning of every public City Council meeting.

PART 4. CULTURAL RENEWAL

Provisions to reduce the stifling of expression and allow for healthy social interaction shall be sought:

a. Repealing Municipal Code sections mandating dance permits.

b. Reduction of hostility to the establishment of dance halls, nightclubs and other such facilities.

c. Removing certain restrictions against smoking, drinking, sitting, lying down, playing music and other forms of expression.

d. Establishing the right to sleep and working with public-private partnerships to create a safe and sustainable campground.

e. Installing public restrooms, lockers and showers in each neighborhood, with multiple covered benches at all bus stops and other points of public congregation, with the cooperation of homeless volunteers for upkeep and maintenance.

f. Incorporating a broader range of public input, including the needs of different age and cultural groups, in public event planning.

g. Uninstallment of surveillance cameras installed on traffic signals along 4th Street and 5th Street.

h. Establishing a City-sponsored free spay-and-neuter program for dogs and cats.

i. Building a homeless outreach center to provide food, counseling, basic services and job placement opportunities.

PART 5. GREENING LAW ENFORCEMENT

A Police Review Act shall be promulgated which creates a standing Police Review Commission with the following duties:

a. To receive complaints directed against the Police Department and any of its officers and employees, and fully and completely investigate said complaints and make such recommendations and give such advice relating to departmental policies and procedures to the City Council and the City Manager in connection therewith as the commission in its discretion deems advisable.

b. To review and make recommendations concerning all written and unwritten policies, practices and procedures of whatever kind and without limitation, in relation to the Eureka Police Department, other law enforcement agencies and intelligence and military agencies operating within the City, and law enforcement generally, such review and recommendation to extend to, but not be limited to, the following:

1. Treatment of rape victims,
2. Police relationship with minority communities,
3. Police relationship with matriculated, currently enrolled students at College of the Redwoods,
4. Police relationship with victims and witnesses of violent crimes,
5. Programs regarding drug and alcohol abuse,
6. Use of weapons and equipment, including chemical agents and tasers,
7. Use of tactics,
8. Hiring and training,
9. Sanctions,
10. Priorities for policing and patrolling,
11. Budget development,
12. Other concerns as specified from time to time by the City Council.

PART 6. SUSTAINABLE EUREKA

a. The City of Eureka should catalogue its exact impact on the global problem of greenhouse gas emissions contributing to climate change, and incorporate mitigation measures in all new public and private developments to sequester carbon.

b. The Samoa Pulp Mill should immediately cease and desist from emitting any potentially cancer-causing chemicals or other pollutants in excess of state-established Public Health Goals.

c. Pedestrian and bicycle paths safely separated from vehicular traffic should be incorporated into the design of all major thoroughfares.

d. Eureka’s public transportation routes must be expanded, with early-morning, evening and late-night service incorporated into a system that emphasizes shuttles over buses. Light rail service should be re-established in Old Town.

e. Public facilities in Eureka and surrounding communities should incorporate photovoltaic electric generation.

f. No pesticides, herbicides or other biocides should be used on school or other public grounds.

g. The growing of Genetically Modified Organisms (GMOs) within the City limits must be prohibited.

h. Eureka should pursue the annexations of forest, creek and marsh areas adjacent to municipal territory in order to protect a greenbelt of undeveloped lands and prevent further sprawl of unincorporated communities.

Resolution Regarding the Recall of State and National Officials

Whereas, The General Assembly of the Green Party of Humboldt County (GPHC) adopted the "Resolution on Affiliating the Green Party of Humboldt County with the 'Greens for Democracy and Independence' Caucus" on October 18, 2004, specifically calling for term limits, strengthened recall procedures and other measures of accountability for officials of the Green Party of California (GPCA) and the Green Party of the United States (GPUS); and

Whereas, The General Assembly of the GPHC adopted the "Resolution on Involvement of State and National Green Party Officials in their Regional, County and Local Organizations" on February 12, 2005, specifically calling for GPCA and GPUS officials residing in Humboldt County to attend, participate and be responsible to the will of the General Assembly; and

Whereas, None of the Humboldt County residents serving as officials designated by the GPCA have responded to the request of the General Assembly, nor have they made any effort to participate in the work of the GPHC or of any of its Locals; and

Whereas, Green National Committee (GNC) member David Cobb and GPCA Grassroots Organizing Working Group Co-Coordinator Dee Brady (both Eureka residents) have specifically declined invitations to the GPHC General Assembly and have ignored the formation of the Eureka Greens; and

Whereas, As a lead organizer of the statewide program for growing the Green Party, Dee Brady has been conspicuously and completely absent in local Green Party tabling and outreach efforts, nor has she contributed to the implementation of the GPHC Grassroots Organizing Strategic Plan; and

Whereas, Efforts by partners in the Greens for Democracy and Independence (GDI) Caucus to spread respect for openness, honesty and responsibility in the internal democratic procedures of Green parties across the country would be bolstered by decisive moves towards these ends within Green-minded communities across the continent as well as on the state and national levels; and

Whereas, The GPUS in its Annual National Meeting in Tulsa, Oklahoma this summer demonstrated a callous disregard for the values, platform and will of the vast majority of members in rejecting the three proposals of GDI to ensure proportional representation, independence from the corporate controlled two-party system of the Democrats and Republicans and the principle of one Green, one vote, among other affronts against grassroots democracy and basic ethics; and

Whereas, David Cobb, who purports to be the representative of this part of California on the GNC, voted against all three GDI proposals, despite the affiliation of the GPHC with GDI, and never even bothered to consult the Eureka Greens or the GPHC on his votes cast on our behalf; and

Whereas, The affiliation of the GPCA with the GPUS expired after no specific action was taken to renew it by the GPCA General Assembly, calling into question why local and state resources continue to be drained into an organization where our interests are not well-reflected. Therefore be it

Resolved, The Eureka Greens demand a county-wide recall election be held to consider the removal of David Cobb from positions in the GPCA and GPUS. Be it further

Resolved, The Eureka Greens demand a county-wide recall election be held to consider the removal of Dee Brady from positions in the GPCA and GPUS. Be it further

Resolved, The Eureka Greens request the voluntary withdrawal of the delegation of the GPCA from any further participation in the GNC or any other organ of the GPUS unless and until such time as the three proposals to re-establish basic democracy sponsored by GDI are adopted and implemented throughout the organization. Be it further

Resolved, The Eureka Greens further request the adoption of amendments to the GPUS bylaws to require term limits and local involvement of all members of the GNC and all other organs of the GPUS. Be it further

Resolved, The Eureka Greens call upon the State Coordinating Committee (CC) of the GPCA to place upon the agenda of the next plenary session of the GPCA General Assembly a proposal to continue GPUS affiliation with the understanding that such affiliation has long since lapsed. Be it further

Resolved, The Eureka Greens reaffirm their request to the State CC regarding the placement upon the agenda of the next plenary session of the GPCA General Assembly a proposal to amend the GPCA Bylaws to require term limits for members of the State CC and the State Bylaws, Finance and Platform Standing Committees. Be it further

Resolved, The Eureka Greens suggest the several local, county, regional and state Green Party organizations across the continent consider implementing requirements for state and national Green Party ‘leaders’ to be required to participate in at least a minimally substantive way in the work of their local, county and regional Green Party organizations. Be it further

Resolved, The Eureka Greens believe all county Green Party organizations in California should examine the voting records of their representatives on the GNC and other organs of the GPUS, as well as the State CC and other organs of the GPCA, in to determine the manner in which they have represented or misrepresented local positions. Be it further

Resolved, The Eureka Greens offer support to grassroots activists across California who concur with the principles of Democracy and Independence and encourage them to run for County Council or Steering Committee seats in their respective communities next year in order to foster a nonviolent consensus-based rebellion against further interference in the affairs of the Green Party at all levels by those beholden to the ‘lesser-evil’ politics of the two corporate parties. Be it further

Resolved, The Secretary of the Eureka Greens shall transmit this resolution to all other GPHC Locals, the General Assembly of the GPHC as well as all County organizations within the Emerald Region, the GDI Caucus, the State CC of the GPCA, all representatives of California on the GNC, David Cobb, Dee Brady and any other GPCA or GPUS officials residing in Humboldt County.

Whereas, The election of delegates to the Green Party national nominating convention and other national gatherings must reflect the will of the membership, with all delegations based on the vote of the membership must be chosen through proportional representation; and,

Whereas, The Green Party should strive for proportional representation of elected officials on the national Coordinating Committee (CC), with the number of delegates a state has serving on the CC to be allotted in as representative a manner as possible to ensure the party has the support and cooperation of its members; and,

Whereas, The Green Party as a Party may work with, show respect for, and act together with members or elected officials from the corporate controlled parties on specific issues, however, this support must not include an endorsement of their candidates; and,

Whereas, The Green Party of Humboldt County has affiliated with the Greens for Democracy and Independence (GDI) Caucus, which is dedicated to achieving internal democracy in the Green Party of the United States (GPUS) and external independence from other parties and/or corporate influence. Therefore be it

Resolved, The Eureka Greens hereby affiliates itself with the “Greens for Democracy and Independence” Caucus formed by Greens loyal to grassroots movements within the Party. Be it further

Resolved, The Eureka Greens call for the following reforms within the Green Party of California and the Green Party of the United States to bring them more into line with the Key Value of Grassroots Democracy:

1) Term limits of no more than four years for all Coordinating, Platform, Rules and Finance Committee members.

Resolution to Condemn Abusive Communications

Whereas, The platform for the Green Party of California (GPCA) specifically condemns “censorship...by those who own the media” as “inappropriate,” calling for “genuine citizen access” to express a “diversity of views,” and

Whereas, The Eureka Greens adopted a “Resolution to Promote Responsible Journalism and Scrutinize Biased Media” which attempted to address legitimate concerns regarding the treatment of the Green Party and its candidates by local media outlets while promoting the creation of healthy alternatives, and

Whereas, KSLG-FM and its morning disc jockey John Matthews have refrained from hosting further attacks upon local Greens by The Arcata Eye owner Kevin Hoover, who continues to deride Green Party organizers with personal attacks while ignoring the existence of open elections and the empowerment of rank-and-file members regarding the shape and implementation of Green policies, and,

Whereas, Humboldt Advocate owner Shawn Warford replied to a call to use responsible scrutiny regarding his publication and its advertisers with threats of legal action against the Eureka Greens and Green Party of Humboldt County (GPHC) Chair Greg Allen, an Arcata resident who has never attended a Eureka Greens meeting, for “intimidation and unfair trade practices,” and

Whereas, Eureka Greens Chair Paul Sanderson, along with Vice Chair Heidi Calton and Local Delegate David Giarrizzo authored a response to Warford’s editorial on September 10, 2005, entitled “Media Reform Seems to Interest All Sides,” which clarified the group’s position while inviting Warford to withdraw his de facto policy of exclusion and attack upon local Greens and welcoming participation in a media reform conference, and

Whereas, Warford’s Advocate has heretofore declined to publish “Media Reform Seems to Interest All Sides” despite hispledge to accept and publish critical responses, as well as having declined to publish the letter in response to Donn Filbert’s inaccurate and libelous statements concerning Green organizing, directed on July 30, 2005 by the GPHC General Assembly and submitted by Michael Smith to the Humboldt Advocate on August 13, 2005, and,

Whereas, Warford’s claim to not enforcing a de facto policy biased against the Eureka Greens does not stand up to the facts concerning his own behavior regarding the exclusion of Green Party members and organizers, and,

Whereas, The North Coast Journal on September 1 in an article entitled “The Story of ‘Jan Johnson’” detailed a series of threatening, lurid and personal messages sent to staff members of The Arcata Eye by a fictitious ‘Jan Johnson’ from a computer terminal within a few feet of the post held then by Warford at the Arcata Chamber of Commerce on the only day of the week he was at this station, and,

Whereas, The Arcata Chamber of Commerce terminated Warford’s employment in April, soon after receiving word of a criminal complaint filed with the Arcata Police Department regarding e-mail threats, and,

Whereas, Anonymous threats against former employers and current competitors, if proven, reflect a lack of restraint from violent communications and represent exactly the kind of irresponsible business practices which damage the reputation of legitimate participants in the media or in any other field of endeavor. Therefore be it

Resolved, The Eureka Greens thank John Matthews and KSLG-FM for having ceased to play host to unwarranted attacks against the Green Party and its candidates at any time after March 8, 2005 and urge continued dialogue towards improved mutual understanding. Be it further

Resolved, The Eureka Greens categorically reject the charges made by The Arcata Eye in an editorial on September 6, 2005 as indicative of the hateful attitude of Kevin Hoover towards individuals which he falsely conflates with the entire Green movement, and challenge him to witness a Eureka Greens meeting for himself before casting sweeping judgments upon people, some of whom he has never seen or met. Be it further

Resolved, The Eureka Greens call upon all Greens to continue the slowdown upon the Humboldt Advocate and itadvertisers with continued lobbying efforts to persuade Shawn Warford directly and through his associates to retract the de facto policy of exclusion against the Eureka Greens and other Green Party organizers in neighboring communities by the Humboldt Advocate. Be it further

Resolved, The Eureka Greens condemn any alleged or potential use of anonymity via the Internet to submit false, fraudulent or abusive communications with the possible intent of impersonating others, unduly swaying public opinion or terrorizing rival publications. Be it further

Resolved, The Secretary of the Eureka Greens shall transmit this resolution to all GPHC Locals, as well as all County organizations within the Emerald Region, the GPCA, all local media, the Humboldt Advocate and any remaining businesses and organizations which still advertise in the Humboldt Advocate.

It seemed only fair to take Shawn Warford up on his offer and make another attempt to share our perspective. The entire point of the Eureka Greens' stance on media reform is to encourage dialogue, and since Sept. 1 there's been quite a bit of back and forth on what constitutes fair use of media.

When we reiterate the Green Party's platform about how "access to information has profound consequences to our democracy," we do so in the spirit of encouraging better access both public and private to the airwaves, Internet and newsstands. If one thing is clear from the passionate statements of the past week, it is the serious interest in honest media by many Humboldt County residents regardless of their party or paper of choice. In this spirit, we hope the upcoming General Assembly at Humboldt State will endorse a local media reform conference, where we'd like to include other local political parties and many media institutions in public debate.

We do regret the talk of legal action flying around in a flippant manner. To our knowledge, no Greens have made any such accusations, and are seeking change purely through lobbying, legislation, public relations and political campaigns. This talk of our supposed threat of a 'boycott' was entirely concocted outside our circle. No statement by any of our members, and no Green resolution, press release or other document has ever called for this. We merely seek to persuade a change in policy.

From all appearances, the Humboldt Advocate is disclaiming any participation in further inaccuracies being spread about the Greens, which means our call for slowdown and scrutiny has met its objective. We look forward to making this clear in writing when our general membership next meets, where we will also discuss the latest revelations regarding abusive or misattributed communications being used to manipulate our local media. We're confident our members will agree about the need to discourage the use of threats in any situation, in keeping with nonviolence.

Resolution to Establish Grassroots Democratic Control Over Public Access Media

Whereas, The platform for the Green Party of California “demands that everyone has a right to access of the various media for the free expression of their viewpoints,” due to the fact that “access to information has profound consequences to our democracy,” and,

Whereas, Public access channels for use by local governmental and educational institutions as well as directly by independent producers have been mandated by law since the overwhelming passage of the federal Communications Act of 1984 by the U.S. Congress, and,

Whereas, Communities including Eureka have hosted public access stations accessible to all Humboldt County residents for over 15 years, the most prominent of which having been Arcata’s Channel 12, which until 1999 was under the auspices of a contract with the independent Arcata Community Access Television (ACAT) and featured a wide variety of local news, commentary and entertainment programs from over 50 independent local producers without fear, favor or censorship, and,

Whereas, Until 1999, the Board of Directors of ACAT was in compliance with state law and its own bylaws in ensuring the regular rotation of the membership of its Board of Directors through periodic elections, and,

Whereas, In 1999 and 2000, a small group led by Roland Yartzoff and closely aligned with City officials, local politicians and the Arcata Eye got rid of most local, independent producers and programming and destroyed the ability of ACAT to function, leading to the termination of its contract with the City of Arcata, and,

Whereas, The current HCTV Station Manager, who previously applied for the ACAT Station Manager position and was denied due to his reporting of a false residential address (which turned out to be an abandoned building), was hired by Yartzoff’s group in late 1999 and turned out to be the last Station Manager ever hired by ACAT, and,

Whereas, During his tenure as ACAT Station Manager, the current HCTV Station Manager admitted to illegally confiscating a broadcast tape from an independent producer instead of fulfilling the station’s contractual obligations to air a public access program, and committed numerous other violations of station rules in clipping shows, including their credits, moving shows unilaterally to different times, damaging broadcast tapes and censoring programming, and,

Whereas, The website of HCTV blatantly admitted that the station is not free of censorship following the hiring of the current HCTV Station Manager, with the Channel 12 schedule dominated by satellite programming copied from other stations such as Free Speech Television and the Classic Arts Network, along with out-of-county religious programming as well as bulletin boards exclusionary of Green Party announcements, and,

Whereas, Despite promises of re-introducing democratic oversight and control of Channel 12, the HCTV Board of Convenors, organized under the auspices of the Humboldt Area Foundation, has yet to hold a membership meeting or call a fair and free election for a new Board of Directors that they intend to appoint directly, or address the governance of Eureka’s Channel 10 or the College of the Redwoods-administered Channel 8, and,

Whereas, Cox Communications, Inc., the cable provider which hosts Channel 12 and administers Channel 10, has been involved in franchise renewal negotiations with Humboldt County and the cities of Arcata, Blue Lake, Eureka, Ferndale, Fortuna and Rio Dell, which include both franchise fees to local governments and direct assistance to public, education and government access to the cable system (including financial support and the construction of a permanent facility for public access channels at the company’s expense), and,

Whereas, With upcoming hearings on the cable franchise renewal process, Greens have the potential to bring this history to light and persuade local governments to establish grassroots democratic control of public access media by holding the Humboldt Area Foundation and HCTV accountable for the composition of the new Board of Directors and the behavior of the HCTV Station Manager. Therefore be it

Resolved, The Eureka Greens applaud the steps taken towards the creation of an independent Board of Directors of HCTV which will meet in public and be held accountable to state law and published bylaws approved by the membership. Be it further

Resolved, The Eureka Greens demand the establishment of grassroots democratic control over public access media stations in Humboldt County through a fair, free and open election of their Board of Directors by any resident who wishes to join HCTV, regardless of economic or other privilege. Be it further

Resolved, The Eureka Greens demand the resignation or removal of the current HCTV Station Manager from their position due to their history and continued pattern of censorship towards Greens and others, advertising the position instead through an open, legal hiring process conducted by the HCTV Board of Directors in public session. Be it further

Resolved, The Eureka Greens call for the immediate amendment of HCTV policies that do not guarantee the complete freedom from censorship for public access programming that is essential to precluding prior restraint of free expression and ensuring that the diversity of viewpoints reflected include Greens. Be it further

Resolved, The Eureka Greens call for the revocation of all banishments placed upon any resident of Humboldt County who wishes to produce public access programming or otherwise contribute to the operation of Channel 12 by any government official or Channel 12 staff member or administrator. Be it further

Resolved, The Eureka Greens request that their local representatives in municipal and county government push for increased support for Channel 12 and other public, educational and government access stations in their cable franchise negotiations with Cox Communications, Inc. or with any other company. Be it further

Resolved, The Eureka Greens ask Cox Communications, Inc. to recognize their obligation to provide increased support for public, educational and government access channels, including the construction of a community media center intended for the use of independent producers. Be it further

Resolved, The Eureka Greens ask the new Board of Directors of HCTV, once elected, to create or amend their bylaws (with the ratification of HCTV members) to ensure elections that are open to free competition, meetings that are public and well-noticed and station rules which do not overly restrict access to cablecast time for independent producers. Resolved, The Eureka Greens believe local governments should conduct a new round of scoping sessions with their residents to determine their particular interests in public, education and government access channels as well as in other aspects of the cable franchise renewal process. Be it further

Resolution to Support Rotation and Accountability for the Green Party of California

Whereas, The General Assembly of the Green Party of Humboldt County (GPHC) adopted the “Resolution on Affiliating the Green Party of Humboldt County with the ‘Greens for Democracy and Independence’ Caucus” on October 18, 2004, specifically calling for term limits, strengthened recall procedures and other measures of accountability for officials of the Green Party of California (GPCA) and the Green Party of the United States (GPUS); and

Whereas, The GPCA met in plenary session on May 21-22, 2005, where serious questions of propriety concerning sizable amounts of party funds were removed from the agenda in an atmosphere of disconnection from the will of the vast majority of Greens; and

Whereas, The General Assembly of the GPHC adopted the “Resolution on Involvement of State and National Green Party Officials in their Regional, County and Local Organizations” on February 12, 2005, specifically calling for GPCA and GPUS officials residing in Humboldt County to attend, participate and be responsible to the will of the General Assembly; and

Whereas, None of the Humboldt County residents serving as officials designated by the GPCA have responded to the request of the General Assembly, nor have they made any effort to participate in the work of the GPHC; and

Whereas, Term limits, otherwise known as rotation of duties, has been an integral part of Green political theory from its foundation in West Germany nearly 30 years ago, and the GPHC continues this commitment with restrictions on the continuous service of its own Steering Committee and the officers thereof; and

Whereas, Prior attempts by delegates from the GPHC to bring up the subject of term limits for GPCA Coordinating Committee members have been dismissed out of hand by the GPCA Bylaws Committee; and

Whereas, Efforts by partners in the Greens for Democracy and Independence (GDI) Caucus to spread respect for openness, honesty and responsibility in the internal democratic procedures of Green parties across the country would be bolstered by decisive moves towards these ends by the GPHC and the GPCA; and

Whereas, The Arcata Greens, a Local of the GPHC, has adopted this resolution and have called upon other GPHC Locals to do the same. Therefore be it

Resolved, The Eureka Greens proposes the following amendments to the GPCA Bylaws, to be submitted directly to the GPCA Coordinating Committee for placement on the next plenary session agenda of the GPCA for possible ratification:

6-1.10 Coordinator Term Limits
Coordinators for all Committees and Working Groups may serve a maximum of two consecutive complete, uninterrupted terms of two years. Partial terms served to replace former Coordinators shall not be computed in this limit.

7-1.13 CC Term Limits
Coordinating Committee members may serve a maximum of two consecutive complete, uninterrupted terms of two years each. Partial terms served to replace former members shall not be computed in this limit. The terms of Alternate members shall not be computed in this limit.

7-3.3 Bylaws Committee Term Limits
Bylaws Committee members may serve a maximum of two consecutive complete, uninterrupted terms of two years each. Partial terms served to replace former members shall not be computed in this limit.

7-4.3 Platform Committee Term Limits
Platform Committee members may serve a maximum of two consecutive complete, uninterrupted terms of two years each. Partial terms served to replace former members shall not be computed in this limit.

Whereas, The platform for the Green Party of California (GPCA) specifically “demands that the concentration of power in the telecommunications industry be limited” through, in part, “...coverage of ALL candidates, whether they are from so-called "major" parties or smaller parties,” and that “everyone has a right to access of the various media for the free expression of their viewpoints,” and,

Whereas, The GPCA in general, and the Green Party of Humboldt County (GPHC) specifically, have faced a history of prejudicial treatment by media sources large and small, and a pervasive attitude of dismissiveness, hostility and even the intent to spread disinformation about Green issues and candidates from local media outlets, and,

Whereas, John Matthews of KSLG-FM stated on his radio program on March 8, 2005 that “I’ve never generally trusted the Green Party because they’re activists, they generally skew the truth," and,

Whereas, Kevin Hoover of The Arcata Eye stated on the same program on March 8, 2005 that the Green Party of Humboldt County is “a very insular, cloistered little group, I don’t think they have a grip on the bigger world,” and,

Whereas, Kevin Hoover also referred to the leadership of the Green Party as “loony toons” in a

March 1, 2005 article in The Arcata Eye, and,

Whereas, Three of the four Green Party candidates in the race for Arcata City Council in the Special Election of March 8, 2005 were given no opportunity to rebut malicious statements made by Kevin Hoover on the KSLG program hosted by John Matthews, despite requests by some to do so, and,

Whereas, In consecutive issues of the Humboldt Advocate on July 13 and 20, 2005, publisher Shawn Warford allowed unsubstantiated attacks, including numerous inaccuracies and libelous statements concerning Green organizing in Arcata and Humboldt County, to be promulgated by Donn Filbert without a reasonable opportunity for response, and,

Whereas, Greens acknowledge the previous reprehensible activities of The Arcata Eye and KSLG, while the Humboldt Advocate has demonstrated the most immediate example of hostility

to the free expression of Green values, and,

Whereas, Greens have the opportunity to promote solutions to biased media by supporting community-based endeavors rooted in openness, veracity, and an uncompromising commitment to challenging conventional wisdom, and,

Whereas, The Arcata Greens, a Local of the GPHC, have adopted a substantially similar version of this resolution and have called upon the Eureka Greens to do the same. Therefore be it

Resolved, The Eureka Greens urge consumers of media to assert their voice through these

community institutions in favor of greater transparency in the ownership, authority structure, news and editorial policies and workplace conditions of newspaper, radio, television and Internet outlets. Be it further

Resolved, The Eureka Greens applaud the steps taken towards the creation of a North Coast Independent Media Center as a healthy alternative for underreported perspectives to make themselves heard. Be it further

Resolved, The Eureka Greens call upon all Greens to use responsible scrutiny in considering the produce of the Humboldt Advocate, i.e. refusing to subscribe to, pick up or tune in their output in any way, shape or form until they are found to have retracted their de facto policy. Be it further

Resolved, The Eureka Greens also call upon all Greens to use greater scrutiny in relation to other businesses and organizations that choose to support, with advertising, the Humboldt Advocate,

i.e. informing these businesses of a slowdown and requesting these advertisers to cease support for the Humboldt Advocate until they are found to have retracted their de facto policy. Be it further

Resolved, The Secretary of the Eureka Greens shall transmit this resolution to all GPHC Locals, as well as all County organizations within the Emerald Region, the GPCA, all local media, the Humboldt Advocate and all businesses and organizations which continue to advertise in the Humboldt Advocate.
